Finally M&S has agree to refund the additional cost . I sent another letter on the 12thJune threaten them with legal action and I got the offer (without any admisssion of liability) today. They stated M&S has no direct knowledge of the facts I was complaining about although it was one of their adviser who spoke to me on the phone. But I need to sign a statement to accept no further claim in the future.
The letter is a bit technical for me but hey I am happy to get back what I am entitled.
My sincere thanks to all the advices on this matter; specially to lucky88. You are a star.

Details of person who has been refunded by MBNA MasterCard:
A week before my scheduled departure date I filled in a claim form on the Oasis website. Then I phoned MBNA and explained I booked tickets on Oasis and they have since gone bankrupt. They ask me when the flights were scheduled for and what communication I have had with them. I told them my flight is in one week and Oasis asked me to contact my credit card company for a refund. The agent said technically I need to wait until after my scheduled departure date before filing a no service claim.
A claim for no service letter arrived through the post a bit later (can't remember if it was before or after departure date) asking me to describe the services I paid for. I filled in the flight details and returned it to MBNA, I received a phone call about a week later confirming the refund.
FYI, my card is a bmi Classic Mastercard issued by MBNA.0 -
Just to let the fellow MBNA card users know that my Oasis transactions have been credited. Additional cost for replacement tickets would be deal with by another department apparently so still waiting on that but glad that the major cost has been dealt with!0

Great news Sqidsworth. Despite my threat to take MBNA to the Small Claims Court, I still haven't received a refund. Looks like I'll be busy next week!0 -

Squidsworth,

Lloyds Tsb has written today agreeing to pay for the additional cost over and above what i had paid for Oasis HK tickets on Air New Zealand, on returning a signed copy of their "without prejudice" letter back to them.
5 Stars for Lloyds Tsb. They have not at any time played games with me.They had always responded to all my letters in a positive manner and not try to delay refunding me for my OHK tickets.
Only John lewis to pursue now.
Please keep up the pressure on your ccc. For those who have been refunded for their original Oasis fare and not bothered to claim for additional costs for rebooking, please just write to them for it with documentary evidence of new tickets. They will pay as they know they are liable for damages.

Hi Squidsworth,
Yes - I do have online access, just checked, but still no joy. I decided to call the MBNA complaints department yesterday, who confirmed that they were aware that Oasis was now being wound up. The girl said that they would pay up the cost of the flights in five working days from receipt of a claim letter (note - this must also have a copy of the web page as confirmation (even though they know - delaying tactics, I'm sure)). I had quoted verbatim from the website in my letter delivered to them last Tuesday, so I insisted that they had all the necessary details. I'll check for the refund this Monday ...
One thing though - the girl also told me that the rest of my claim (ie. the differential in cost between Oasis and the equivalent BA flights that I bought) would be dealt with by their Legal department, and she could not confirm any timescales!
I ain't giving up ... :mad:0 -
Hi
Goldbunion - my flight dates have not yet passed. MBNA needed to pay out because Oasis is now officially in liquidation so they have now breached the contract. Mine was a MBNA visa.
Johnjohnstone - They got my letter the week before so I'm probably couple days ahead of you and I did send them a copy of the KPMG announcement (just because I had no faith in them). Got a letter from MBNA confirming the transactions had been credited. Hopefully you'll get yours next week. I've also been told the extra losses would be dealt with by another department and I've been told it'll take 7-10 days on two occasions so I'll give them a call before end of the month.
Hang in there...0
