I will indeed proceed further with MBNA - I am thinking of contacting Visa to check on MBNA's claim that they had been advised by Visa not to pay out. Re financial ombudsman - i think i can fill in the complaint form and send it back since i've now got the final reply from MBNA and see how it goes. I'm thinking of going down the route of court for small claims as well. But might wait after 11 June to proceed with that option, as I think Oasis got a court hearing on or around that date.

greentea328 - Although MBAN refused to pay out for now and asked me to submit my claim in Sep instead, they did put my transactions in dispute and they dont incur any interest. So at least they should do the same for you.

Quoted in the Standard newspaper on 15 April: http://www.thestandard.com.hk/news_detail.asp?pp_cat=30&art_id=64455&sid=18493264&con_type=1&d_str=20080415&sear_year=2008

And again in the Standard newspaper on 27 May: "As for situation with Oasis, Lee said the liquidator has to tell the court whether there will be a white knight or if it has to be liquidated before June 11." http://www.thestandard.com.hk/news_detail.asp?pp_cat=11&art_id=66410&sid=19089206&con_type=1

Ah right, thanks. I did see that when it was released. I was just hoping that someone was going down for the whole mess :p

    Check your account balance.

This morning i've been credited. This is despite sending no letters and purely over the phone contact. Think you just need an operator willing to help, sweet talk them a bit.

    Thanks for all your help!

I LOVE HALIFAX DEBIT DEPOOOO

    Hey there

Just to make sure...you got money back from th halifax after using your visa debit card? Had you paid for any special protectiones for the card?

I'm having real problems with the Halifax visa debit people. They say the charge back just doesn't apply to debit and that my claim's been rejected. They're now sending it to the Liquidation dept of the Link and debit card services dept but I don't hold out much hope. Exactly what did you do?

    Thanks for your help!

I wrote on here last week asking for advice on getting money back from Halifax credit cards. I was adviced to go into the bank and ask for a form to fill in. My branch said they couldn't do anything about it as it isnt anything to do with them. I sent them a letter at the beginning of the week saying its up to them to pay up. Obviously still waiting reply. I just rang the disputes department now and they have said I have to wait to hear back from the liquidators before I come back to the bank. Any advice?? No one seems to be shifting!

You are being taken for a ride by MBNA ! VISA have nothing whatsoever to do with your claim.
Given MBNA a set time to pay up (14 days ?) then take them to Court - you WILL win - they are acting unlawfully.

It is obvious to us that your ccc is taking you guys for a run around and in a way bullying you guys or insulting your intelligence.Your ccc must be having a good laugh at us all, fooling us. Well, wipe the smile off their faces and issue a court warrant on them!!

Just write a final notice letter giving them 7 days notice and tell them it is they who are in breach of contract. Enough is enough, dont be nice to them anymore. I also got fed up with john lewis. they ignored several letters until the one i wrote giving them 7 days to pay up. And they did!!

Get writing and dont waste your time anymore. it is like watching you guys squeezing blood out of a stone. In court, if you prove to the court that they wasted your time, you can ask for compensation too.

Remember if they let your claim go to court, where you are guaranteed to win, their legal representation bill will be several times what your claim is. so do you think they will let you start court proceedings when they have no chance of winning.

DELAY NO MORE AND GET YOUR MONEY BACK LIKE THE REST OF US DID!!

Further to my previous posting last Thursday 22 May, it seems that HSBC have blatantly lied about refunding me my tickets despite me threatening them with court action. I was promised that the money would reappear in my bank account by today but that has simply not happened. I previously wrote to HSBC and told them that they had 14 working days to respond or I would take the matter to the Financial Ombudsman. I now have no choice but to take the matter to the courts and ignore the financial Ombudsman as you have suggested. Have tried phoning HSBC's India-based Disputes Department on 08456 039952 (UK office hours only!) - the phone rings continually but no-one is answering(!) I'm really fed up.

Has anyone had experience of going through Her Majesty's Courts Service regarding this or other related claims? What is the timeframe and costs involved? I can't seem to find them from the moneyclaim website.

    go to www.moneyclaimonline.gov.uk

there is a phone line where you can get help in filling in the forms and they will then do the rest.

court fees are according to your claim amount. for example, over £1000 it is £70 i think. below £500 would be half that.cant remember exactly but it's on their website.

All court fees are refundable from your CCC just add it to your court papers.

Once you have filed, they will write to your ccc about the impending case and will then give your ccc 19 days to respond as to whether to pay or contest your claim in court.

if the latter, the agency will choose a county court near you.

i doubt it if your ccc will go to that length. remember all miscellaneous expenses can be claimed. like baby sitting, taxi or train fares etc.

your ccc is obviously not your local bank with a call centre in india!!
