Thanks for the advice,lucky88 !! after I cool down and calm down, I might do just that. I'll still write to the chief of Barclays to complain though0

After sending a letter and supporting documentation to AA credit card on my parent's behalf. They have now replied trying to fob me off by going direct to Oasis. I'm not sure what do now.0

I am writing to Barclays Bank, the new owner, then take them to court.
I would think twice about using my Goldfish card again, just think of all the consumer protection that I am NOT getting. I would like to hear from anyone who succeeded with Goldfish.
Have a look at post #325 from Moonrakerz. He got paid out by Goldfish plus additional costs which were quite large. (Dont know if he checks this site anymore as I think he is all 'done and dusted' now.)
I suggest though that you read all of the posts from page 14 onwards (if not before) and this will give you all the amunition you need. it is well worth your time.
You will see that your credit card company are - by law - EQUALLY liable for the contract which you entered into. The contract has now been broken and that is the basis for your claim. You can choose who to pursue the claim with and obviously in this instance it is the cc company.
Dont get mad - just get even! though I must admit it can take more persistence than should be necessary.0 -

tell the AA, that they are under "joint and several "liability for breach of contract. what this means that in a court of law; the judge will tell the party which is nearest, solvent and easiest to meet the contractual obligatons of your contract. so since oasis is insolvent and under hk jurisdiction, the court will instruct AA to pay up.simple!
S.75 states this legal principle, tell them this.
you can write them and tell them this or get a lawyer to write on your behalf but may charge you £100 though it will be more effective a letter from a law firm who will add that if our client dont get his/her money back they will initiate litigation in county court.
you can add all this yourself, be firm and tell them you know your legal rights but dont sound threatening.
good luck!
ps they should buckle with this letter. why? because all your legal fees will be awarded by the judge when they lose plus interest on the amount disputed. their legal fees will be at top rate and may cost more than the disputed amount. finally, if the AA lawyers are good at their job, they will advise the AA not to go to court because they stand no chance in winning thus sparing them more fees and time.0 -
My husband paid for our flights on his First Direct credit card. We sent them all documents relating to our claim.
We got out to HK but oasis went bust during our week there. We had to return via Paris with cathey Pacific then easyJet to Luton then train to W. Sussex. First Direct tell us they are waiting to hear from Visa International regarding claims. Are we being 'fobbed' off.
Can we claim for the cost of the Oasis return flights AND the Cathey/Easyjet/train journeys as well?
Anybody know or can advise?0 -

yes, you are being fobbed off.
yes, you are entitled for the flight back to uk.
yes, you can claim the train tickets.
see posts from page 14 onwards. dont accept their excuses which are not correct. they know you are entitled to all the above.0 -

How long have you been waiting? Yes, the transactions would have gone through visa international, and it is reasonable for First Direct to ensure that they show up on their information systems. But this should be a matter of a few days at most.
And 'yes' to your other questions.0 -

I don't think you can double claim ie the Oasis return portion and the replacement flights as you cannot 'benefit' from the situation.
But whatever additional expenses which you would not have incurred had you come back direcely with Oasis, are claimable. This might be meals, accommodation, etc. You would need receipts though.
I dont know about claiming for the stress, which was doubtless extremely high for you.
Good luck.0 -

well done! i did the same, used 2 credit cards/ lloyds tsb said they will refund me after receiving a signed declaration from me. sent it off last week, still no credit to my lloyds card.
john lewis wrote today giving excuses like requiring liquidators letter and go claim from my insurance company.well, i called the ombudsman straight away. got hold of a case worker who told me they will write today to them highlighting of equal liability under the 1974 CCA.
the ombudsman lady said why should i claim from the insurance company, it would be claiming from myself.she said it was totally all wrong. so, she said she would write to them today!
got a file number and the ombudsman told me if they still dont pay me they will send me a form to fill in and thus open a formal case against them.
lets see if their informal letter to them will work or not.
