May need to wait for a few days more as KPMG did say that they were confident that a buyer may come forward in a few days and they are Hainan Airlines and Cathay - would rather be Cathay cos' Hainan Airlines is another local budget airline!

this puts a new angle on things... i was told the refund would only go through if there was no chance of my flight occuring. oasis told me they were 'virtually' certain it would not be bought out. was the kpmg announcement official sybilc or is that just what someone in the call centre said?

sybilc, was this an official statement or just from someone in the call centre? i can't get a refund until there's definitely no chance of the flight taking off so this could put a spanner in the works...

I contacted 08457 404 404 (the number on the back of the card). i went through all the stuff then spoke to a sales person.

I thought i read something that sounded like there might be a buy out and then i heard Hainan Airlines had pulled out. All rumours at the moment though. IMO I don't think they are being brought out.

can some one clarify that only the credit card holder is covered. so if you paid for you other family member they are not covered? it doesn't seem right to me. surely, it covers the credit card holder total loss.

You would have thought that the website would not be talking about refunds if there was a possibility that they were going to be brought out.

Thanks for the reply moonrakerz. I have found something useful that is related to Section 75 of CONSUMER CREDIT ACT 1974 from Office of Fair Trading site:

    SAFEGUARDS FOR THE CREDIT GRANTOR

1.10 Subject to any agreement to the contrary he may have with the supplier, under section 75 the credit grantor is entitled to be reimbursed by the supplier for any loss he suffers from the result of a claim. This includes all costs reasonably incurred in defending the claim, and the cost of meeting if the claim is upheld. The credit grantor can also have the supplier made a party to any proceedings brought against him by a customer.

1.11 If the supplier has gone into liquidation, however, or is otherwise unable to honour his obligations, the credit grantor will not, in practice, be able to recover money from him. (Credit grantors may like to consider whether to take out indemnity insurance to cover such a risk.)

Can I use this as argument against Natwest in the future and ask them to claim from Oasis directly if the abovementioned situation occurs? Would it be acceptable?

I take this to refer to claims from the credit card company against the Airline. This is nothing to do with your claim against the card company. You don't have to ask them to do anything, this 'aint your problem !!

The Law is quite clear about what you are entitled to. I would not be messed about by these people. Write to them and give them 21 days to pay up or you will issue a summons in the County Court.

I just contact HSBC, they said they cannot refund the full amount to me, because from my bank statement it is not debit from Oasis Hong Kong Airline instant it was debit from a travel agent.

Now i am completely lost
