Oasis airline in liquidation- what to do?

But now, I got a question that lingering in my mind. Is it possible that in the future got another company that agrees to buy Oasis and then Oasis will continue their operation as usual after let say I got the refund?

Maxjet issued a statement saying: "that our service to you was not delivered nor will be delivered" (my underlining),
I would not have thought it would be too difficult to get a similar statement from Oasis, if they haven't issued one already.0 -

Thanks for the reply moonrakerz. I have found something useful that is related to Section 75 of CONSUMER CREDIT ACT 1974 from Office of Fair Trading site:
SAFEGUARDS FOR THE CREDIT GRANTOR
1.10 Subject to any agreement to the contrary he may have with the supplier, under section 75 the credit grantor is entitled to be reimbursed by the supplier for any loss he suffers from the result of a claim. This includes all costs reasonably incurred in defending the claim, and the cost of meeting if the claim is upheld. The credit grantor can also have the supplier made a party to any proceedings brought against him by a customer.
1.11 If the supplier has gone into liquidation, however, or is otherwise unable to honour his obligations, the credit grantor will not, in practice, be able to recover money from him. (Credit grantors may like to consider whether to take out indemnity insurance to cover such a risk.)
Can I use this as argument against Natwest in the future and ask them to claim from Oasis directly if the abovementioned situation occurs? Would it be acceptable?0 -
This thread has grown! Just a quick update.
I have spoken to my parents regarding the situation. They have rung up the credit card company (they paid via an AA Visa credit card) as they were not having much luck with Oasis (not answering/busy tone/automated message regarding the situation).
My parents purchased tickets a month ago for this Oct. They have already received the credit card statement with the Oasis charge and is due for payment at the end of the month. They were a bit unsure whether to pay or not and worried about potential interest charges. They spoke to someone at the credit card company and they tried to fob them off with the phone number for Oasis, but my parents told them they were having no luck with Oasis directly and it would be quicker to get a claim/refund via them. Whoever they spoke to on the phone told them that they would not have to pay the outstanding charge and that they would sort out a refund for them. I am a bit skeptical because they did not say whether that they would send out a form or say whether they would be charged interest. It seems quite vague. My parents have written down all the details of the phone call etc. We will see what happens.
My parents are on the hunt for new tickets (3 return flights in Oct). BA seem to be the cheapest.0 -
MBNA said exactly the same - that the company may still be taken over as it has not been wound down in its entirety and refused to cough up until they had final confirmation or my flight date had passed and the plane did not take off. irritating since i have paid my cc bill and they are getting the interest0

leedseagle- Originally my parents booked 3 return flights with Oasis (2 adults, 1 child) for approx £1120 for mid Oct for 17 days. I did a search matching the same dates direct on the BA website and they quoted £1300.50.
I am not sure if my parents are gonna try and claim for the difference in price plus I am not sure how soon they will purchase the new tickets. I supposed that they would have to go about it in writing. Will it make a difference if they purchase new tickets via a different credit card?0 -

lloyds tsb said that i had to write in to their dispute dept in brighton with statement of payment and all relevant documents. any lloyds tsb credit card holder like to share info and how to write to them and pass on each others experiences with their agents.
i also used waitrose mastercard who were more helpful and asked me to fill in their dispute form which they are sending.
both card operators arent fully aware of the cca 1974. they are just the front line staff. we need to speak to a person in their dispute dept directly.
rebooked on air new zealand, iata bonded, for 4 pax in july for £2500 using expedia. cathy and ba wanted £4000+. that's why cathay just announced record profits. oasis debt is not high for 5 jumbos. i think the banks may have pulled the plug like northern rock.0 -

Hi all,
I also paid my ticket in August last year on my Citibank Visa but am not flying til June. In this case, would I need to wait until the departure date to ask for a claim? The above links are both very useful but I am not sure if they are applicable under the Hong Kong law as I live here. Could somebody give me some advice please?
I have managed to get through Oasis's call centre. I was informed that at this stage, any refunds will need to be registered but they can't confirm how long it will take to process or how much I will get refunded.
Like most of you, I am in a bit of a dilemma. I have been planning and looking forward to the Europe trip for a while. At least those who are in a hurry to go back or come to HK in April have offers by CX and BA. May need to wait for a few days more as KPMG did say that they were confident that a buyer may come forward in a few days and they are Hainan Airlines and Cathay - would rather be Cathay cos' Hainan Airlines is another local budget airline!
On a seperate note, those who ARE still coming to HK for a holiday, feel free to ask for any questions, I can give you the best tips where to visit/eat/shopping!! :beer:
BTW, may rebook my trip to London on Air New Zealand. They seem to be pretty cheap and their seats are a bit bigger.0
