  • if you've been married yourself you should remember the vows "for richer and poorer". so she should really be intitled to something if not half of everything they have ear'nt and saved in their very long marrige.including his pension.

If you'd taken the time to read my posts you would have seen that I am all for her getting everything that she's entitled to, always have been, its my BF that is being cagey about everything and trying to duck out of his repsonsibilities by not divorcing her and keeping his pension intact, I WANT HIM TO DIVORCE HER AND SORT OUT THE PENSION ISSUE, hope this clarifies things, Thanks to Errata for your comment, her NHS pension goes into the pot too, fair's fair.
I was married 30 years, no savings or pension came my way.............

I have just been reading some of this thread. Question, who initially asked for the separation? Sounds like it was the wife.

Another observation - If he does not get a divorce and you set up home together, you have no rights when he dies, (wife gets everything regardless of how many years they have been separated)he can't love you that much if he is willing to let that happen to you because he want to keep his pension and any solicitor worth their salt would tell him that losing some of this was on the cards anyway so there's no point in waiting.

    Hi,
I have replied to this post twice and both times have been logged out and had to log in again to find my reply has vanished, lets hope this time it s third time lucky:mad:

They were having lots of problems and she asked him to leave the marital home, he refused so she left her 4 kids and went to live with her Mother, a separation was agreed on and the sale of the house, it needed work doing to bring it up to scratch so she returned while this was being done and they shared the same bed and i assume other things too:o

The house sold and they both bought their own property 60/40 split in her favour.

They have been separated almost two years now, I'm not sure if i want to rush into another marriage just yet, but do want him to be divorced and not still married to her now we're are together, not an unreasonable request me thinks:D
