    Its just that all this started in around June/July...........I spoke to all my creditors (apart from NatWest) and I have been paying two of them above the amount that CCCS has advised me to pay, only because they have told me that they can only offer me a lower repayment if CCCS are dealing with them directly. When I told CCCS this, they said because my surplus is too low, they cannot put me on any arrangement plan:confused: The last time I spoke with CCCS (some time back in September, I think) they started asking me about selling my property etc...........I didnt feel they were doing enough for me or helping me...........they sounded just like my creditors in fact:mad: . May start all over again and speak to Payplan.

    At the moment though I do need to find the best basic bank account.

    I currently bank with A&L (basic account). They were the only people who'd offer me an account based on my circumstances at the time (split with ex, plus was in shared DMP with her).

    It's not a wonderful account (cash card only). That said, they do allow you to set up electronic transfers online and you can have DDs and the usual.

    You don't get:

    Debit Card
    Cheques
    Standing Orders
    Full online functionality

    But it's an account and it works.

    I have just been looking back over your thread - I had to skim, sorry, due to lateness of the hour, so I may have missed something vital. I had a few thoughts arising from it. I know these get onto personal territory and I may be completely wrong so please feel free to ignore if I'm out of order. (Or tell me if you prefer!)

    Any luck looking for evening/weekend work? There are still a few seasonal jobs around. Our Tesco is looking for staff on a 3-week contract.

    I know you didn't post an SOA as you are cutting right back already (and have been for a long time). I just wondered if doing one now might be of use, as the economic climate has changed and it may be the goalposts have inched over a bit and someone can see some leeway somewhere. I do respect if you think not though.

    I know you mentioned at one point you were finding it hard to eat - I hope you can get some food into you now, being nourished and rested (even if you don't sleep) makes a big difference.

    Lastly for now - have you talked to you doctor about the depression? Mine was surprisingly helpful to me though I went all prepared for a prescription and didn't get one so having geared myself up, I felt flat for a while. She didn't even say much I hadn't heard before but there was something about the way she said it and the fact she gave me some reading material to go away with (ie something concrete to do) and wants to see me again. Do consider this if you aren't seeing the doctor, you are under a lot of strain and there may be something they can do to ease it.

    Meanwhile I hope you find a bank account soon.

  • sporter- i know it must be really really hard, trust me i know my parents have been in that situation. Everyone on here is here to help, everyone has a story to tell and here's mine typed down, black and white, no lies and no pretence.
    I'm a sixteen year old (girl) and a month ago my dad left us because his life was based around money(and to this day it still is). He pushed us away, he wouldn't talk to us and he is in a very very dark place. We tried everything counselling, absolutely everything, but he doesn't care, all he cares about is money and spending and buying etc. We were his family, now he doesn't want to know us, he wont talk to any of us. Money is far far far less important than family and love. What me, my mum and my brother(23) was horrific it was like watching someone die. I don't miss my dad, i don't really want to know him, because i know i will be let down by him, i miss who he was and i don't want to know what he has become unless it is himself again. He has lost everything, and in a way so have we, but we all know we have each other and everything after that matters a lot less than our love for each other.

    I don't know if you have any children but even if you don't PLEASE PLEASE PLEASE do me a favour don't let money rule your life, my family has been torn apart by it and trust me its not something i would wish upon anyone!

    hi hunni, just read your thread, big hugs, I know how you feel hun, I have been there myself but the above bit stuck in my head and is a load of tosh hun, they could very easily accept a lower installment. You need to stand your ground, sit down and type up a basic monthly budget showing what you pay out, have coming in and what ever is surplus in this case just under £30. Write an accompanying letter explaining that you were unable to continue on a dmp with CCCS however they have recommended figures based on your enclosed budget also taking into account that you have xxx other creditors and they suggest a monthly payment of £xx.

    This is what I did as over the phone I was told by Blair Oliver and Scott they could only take £5 a month, yet they told me that 2 days after I had sent a similar letter to above and they accepted my lower offer in writing. You may also want to mention your depression and the detrimental effect the stress all of this is having on you.

    At the end of the day hun, they cant have what you don't have.

    Hi Sporter. Don't let the barstewards at these debt chasing companies get you down. As a few peeps have pointed out they can't have what you ain't got!
    Chin up, it is possible to get out of debt, just remember keep up with your priority debts, the rest of your will just have to wait for their money.

  • Hi guys.............I'm still here (just about):o

    I managed to open a Co-operative Cashminder account at the beginning of January.........:T ...............then I made the mistake of asking for another one in order to have one for bills etc and one for personal use. It declined me on the second attempt, said something about adverse credit:confused:. Anyway, lucky I got the first one. The lady at Co-op said it may be due to the fact that my first account isnt up and running yet, so they have no idea of how the account is going to be managed.........never mind, at least I got a new account with NO overdraft facility.:j

    Anyway........my creditors have all started to ring me again:mad: . MBNA wants £92 per month (I have been paying them £14.01 each month) and says that my account will soon be taken over by debt collectors. Asked them if they wanted me to go "on the streets" and if I had £92 dont they think I would be paying this towards my debt already (duh!). What I couldnt understand though is that M&S has been taking £4 each month and has recently sent me another letter stating that they are putting me on an arrangment for the next 12 months to pay £4, but that my account has now DEFAULTED...........I thought my account could only be defaulted if I wasnt paying anything whatsoever. Can someone please explain this to me:confused: . I rang them and said that since last year, they had not asked for an increase in payment, although I did write to them only last week saying that my situation had not changed and that I would like something in writing to confirm the way forward. The lady said that they are still going to keep my account, but that it has now defaulted. So, I have to ask myself, what is the point in increasing payment?

    Barclaycard still getting £44 per month. No problem there.

    Sainsburys have given my account to another company called IQOR. They rang me during the week and said that I should continue to pay the £10 (increased from £5) to them and rang to let me know that they had taken over. Fine, I thought. Then I received a letter from them today saying that Sainsburys Gold? had passed the debt to them with instructions to recover the balance of £5,200 IN FULL!!:mad: I dont understand that I just spoken to someone from that company only 2 days ago who confirmed I should continue to make my £10 payments at the end of each month, only to receive this letter. I shall be calling them TOMORROW WITHOUT FAIL!!

    If anyone can advise me what to do next, please feel free as I am good for a couple of months and then it all starts kicking off again!!!

    but I think that usually means its going to or has been passed to a DCA

    Had you sent the letters requesting that communication be in writing only? If so, report them to OFCOM, TS and OFT.

    That may be good news. Some DCA's are easier to deal with. Have a look at your T&C for the account if you still have it and see if the DCA are alowed to charge you interest or not.

    Sorry, but that's incorrect. When you made the initial agreement with M&S, you stated that you would pay the minimum payments. This is the agreement that has defaulted as minimum payments are not being made. Yes, you are making agreements as arranged with M&S, but the original agreement has been broken and can therefore issue a notice of default.
    So, I have to ask myself, what is the point in increasing payment?
    When an account is defaulted, it basically allows them to proceed with court action should they wish to do so. If no default is issued, then i don't believe they can take any court action. This does not mean however that they are taking you to court. The default will remain on your credit file for 6 years though.

    This may be an automated letter sent out when a new account is taken on. Get you written confirmation of the agreed repayments.

    Don't call them. Write to them so you aren't speaking to an agent who may be on commission or something. State what has happened, what your previous agreement was and that as your circumstances have not changed are offerring the same payment to them.

    That's my take on it anyway.
