    New to forum here.

    Its nice to see everyone is helping you. Any advice is good advice no matter how small.

    I was given this site by my mate, and its quite handy as it give lots of info on debt,loans,money etc. Has videos and has questions/answers about debt too. Might be useful for others here too maybe.

    I am to new this website i have just recently posted a SOA, i two owe quite a lot of money and i must be honest i too have had your feelings and thoughts and although we do not like to admit this we all need to take a deep breath and grabb those debts by the horns and try to deal with them as the best we can, just take it day by day and try and think positive what keeps me going is my daughter and wanting the best for her life, i want to be there to see her grow.

    Please just try and be positive.

  • Just received a letter from MBNA (after speaking to them numerous times already). This letter is actuallly saying that they know I am a homeowner and that they may pursue litigation action and seek a CCJ that may result in a Charge Order being placed on my property.

    I rang them and spoke to a "nice" lady, who said that unless I pay them approx £95 to £100 per month, then by next month my account will go to Debt Collection.

    Told her I cant afford it............

    i too just read through your entire thread, and just wanted to say well done. the support you've recieved so far is amazing, and i know it sounds cheesy but while i'm here, i may as well say thanks to everyone who's written posts on it, it's been helpful to me, and it's nice to know there are actually people who care :)

    Good for you! If you haven't got it, they can't take it, however they may phrase their pressure.
    Loads of good advice above about putting things in writing - is there any particular reason why you prefer to phone? I think there may be standard letters around which you could cut and paste. The first one is always the hardest.
    Anyway it's good to hear from you, andI'm pleased you got the new bank account.

    I don't like these stupid threats they throw around like that. Have they said anything similar in a letter? As far as i am aware, the legislation still states that you need to default on a CCJ before they can get a charging order. There was talk of bringing new legislation in but this has not been passed yet, afaik.

    Is this for a loan or credit card? If so, have you requested a copy of the credit agreement?

    This is for a credit card............all my debts are cards and an overdraft with NatWest (hence why I have moved accounts).

    This week is my week of writing letters and speaking to CCCS again. But another thing I am worried about............as you may remember, my fixed rate mortgage ends in May with the Halifax. Obviously I will be staying with Halifax (all payments up to date, no defaults, no missed payments etc), but what I need to know is now that I have a default on my file (M&S), will this affect my new mortgage rate when the time comes. As interest rates are low nowadays and I am currently on a 5.9% rate, do you think I will get a better rate, or has my file messed this up for me. Also, if I defaulted with MBNA because I cant afford the £95 per month, will this also make my mortgage lenders give me a rubbish rate as I will have 2 defaults on file OR do I try and pay the £95 for the next couple of months, just until I hopefully get a good mortgage rate and then default after that:confused:

    (hope you didnt get confused ..................because I am!)
  • Don't panic, you may find the new rate is cheaper anyway especially if on variable terms as standard.
