I made the mistake of taking out 2 of phones this time last year and only ever received one cash back (the first one) despite numerous phone calls (which you can never get through to anymore - they direct everything to their website) emails, threats etc they still have made no attempt to make payment. I am owed at least £480. If anyone has any advice im all ears ........

    try calling 08700 200 200

There's a thread on Click Mobile. Better look it up - not had a lot of use in a while that I've noticed!

Could you guide me to click mobile thread, I tried but could not find it. Thanks.

After going down the small claims route and getting a cheque out of them I have now received a letter from my local court with a form to fill out because Telco have defended the claim, there defence is :-
"The claimant did not enter into the contract referred to with this company. The correct company against whom he should have claimed is Yes Mobiles limited"

I have spoken to the court and explained that the claim has been settled, they need this is writing so once I am sure the cheque has cleared I will do this. I also noted that the cheque was from Yes Mobiles.

They also wrote in February on another matter and the letter had a Express Mobiles logo on it.

All very strange, my next claim is due soon so it should be an interesting what happens this time.

could you please explain what the smal claim is I have no clue, I have submitted my claim to Express mobiles on the 6th of Feb until now I have not recieved my cash back. I come to a situation where I can't pay Orange network I have emailled Sally many times but no change. I want to take them to the court please share you experience what the process. thank you very much.

I DID WONDER IF I CANCELLED MY CONTRACT WOULD I BE LIABLE SINCE THE CONTRACT HAD BEEN WITH EXPRESS MOBILES AND NOT ORANGE, :p:p , COZ ORANGE DID NOT SEEM INTERESTED IN MY SITUATION:confused:

I'm not sure what to do about claiming my court fee back. I know many of you have bigger fish to fry but having just had to make a court claim in order to get my 3rd installment of money back I have lost out on 25.00.
Do I take Telco to court over this since they are defending the case or do I postpone it and add it on to my next submission as no doubt there will be one.
I did'nt actually add on my court fee to the amount for claiming on the form just kind of presumed the court would order them to pay it. However this was'nt the case.
    Any ideas most welcome.
I have to send back court form by 26th May.

Did you add the court fee's to the total that you were claiming??. I did.

So should I have claimed for 145.00 instead of the 120.00 they owed and then added the court fee?

Your claim should be for the amount they owe you, and a separate entry to add in the court fees.

If you claimed via MCOL this is done automatically.

You can also claim interest on the overdue payment (based on 8% a year).

See post number #152. this explains what I did.
They seem to now be defending these claims by saying that the claim should be made against Yes Mobile.
