Yay well done!DeltaH3937 said:Won purely on the basis of the tenancy agreement / lease does not stipulate the requirement to display.
Foolishly, the claimant also provided this document where by this stipulated the same as my witness statement so they made it a loss for themselves. So on that basis, judge dismissed.
I would write to the PPC next week, if you are still living there, and tell them to stop policing your bay and CEASE AND DESIST with PCNs because you do not have to display a permit and a Judge at xxxxx court on xxxxx date (claim number xxxxxxxxxx which they lost) has confirmed that the Defendant's lease (and the fact you pay £150 pm for the right to park) has primacy.
Tell them anyone going on your property is trespassing; no PCNs are to be issued in future in that bay which is hereby opted out of their little scheme, forthwith. Any existing PCNs must be checked for and cancelled immediately.
Copy in the Managing agents and state that:
damages of £75 per event will be pursued if PCNs continue to be issued because this is a private nuisance for which there must be a remedy. £75 for one trespass incident was the sum ordered in the Ransomes Europark test case in Ipswich, so this is a fair and legally tested benchmark. This is fair warning and acceptance of these terms or conditions will be by conduct.
The same sum will be incurred if an employee or agent connected to any parking firm uses the bay in question in any way. To be clear - get off my land.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Congratulation on your win. Another scammer losing their court fees, £95 and all their other associated costs. We can but hope they did pay a rent-by-the-hour paralegal who was stuck in traffic somewhere too.

Omg absolutely! How poorly unorganised I was and how with the support of this forum alone, was I able to evade these parking pirates.
Look back to 8 months ago when you started this thread and how close you came to screwing it up with wrong deadlines. Hopefully you can look back on this experience and everything you learned about the court process and point other victims to this forum.
no longer do I live on the same development and have since moved to a house with 3 parking spaces included (aka driveway haha).
I’ll absolutely point people In this direction and happy to donate my loss of earnings won today to this benefit of the forum if that’s an option?
thank you again!

The only payment we require (and are permitted to receive) is your thanks and of course sticking around to help with consultation when it opens. If @Coupon-mad has not mentioned it on this thread already, she soon will.

Happy regardless and in that case many thanks again.Le_Kirk said:The only payment we require (and are permitted to receive) is your thanks and of course sticking around to help with consultation when it opens. If @Coupon-mad has not mentioned it on this thread already, she soon will.

I do have a question of how to go about claiming the £95 loss.. may have missed it but do believe there is info on this on the site.0

You should be sent a cheque during April. If it doesn't arrive, email and remind the legal firm what is owed by their client, and tell them you will enforce it with bailiffs if it is not paid forthwith.
Anyway:
ANOTHER ONE BITES THE DUST!
You won! CONGRATS!
See you back here for the final DLUHC Public Consultation, coming very soon. Please read about it and be ready. UK motorists need people like you to help us make a difference forever.
What a waste of your time this was, and why should there be such a threatening litigation culture in parking? Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture. There will be one window of opportunity very soon.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps intended last year, but blocked by the greedy moneymen.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest
Read only the latest (2022) posts there. The PPCs have blocked the new Code by filing for Judicial Reviews.
Stopped the much welcomed parking code from February 2022, which stated that added £60 or £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50. It's all on hold...
Motorists urgently need the statutory Code reinstated and the ban on false 'DRA fees' confirmed, to stop the rot and the toxic litigation culture.
This will be your chance to make a difference, plus other drivers you know (family, friends) who are also fed up with greedy and unscrupulous parking firms and the stranglehold they and their 'legals' have on people.
We need VERY high numbers of real victims to make a point of responding to this final Consultation.
Coming very soon....and it will be all over the forum for several weeks. Don't miss it.
Your only chance to change the law.
