totally confused County court business centre

Options
My wife has received a letter from the county court business center relating to a parking eye penalty notice which she has been ignoring.   The infraction that the penelty relates to is overstaying the permitted parking times by 20 mins or so at a local Farm foods / B& M car park.  On the date of the infraction she was unable to leave the car park due to a punctured tyre and had to wait fro me to come home from work to go to her aid and change the wheel on her car before she could exit the car park.

That's the back ground to the day in question ...... has she buggered herself up up by ignoring the parking eye letters and is there anything I can do now to make the whole sorry mess go away without having to pay the county court business center the inflated fee of £185?   the original fee was only £100,  with a lower fee either £50 or £60 she can't remember which, if paid within so many day. She never told me sooner as she was afraid i would freak out after all i paid her last PCN. i would gladly pay the lower fee if it was possible .  Well maybe not gladly  but it would stop her worrying about an impending court case.

  • Somebody on another form has suggested that she contacts parking eye and te them i was the driver on the day of the infringement .... and this would force them to resend the pcn in my name and also they would have to offer me the oppertunity to pay the lower 14 day penelty ........    is this true???

Not once court proceedings are commenced, no.
  • have court proceedings been commenced ? My understanding  is that County court Business centre is a debt collection agency not an actual court.
  • You dont pay the CCBC.    Please read the 'Newbies' , as everyone is advised to do,  and lots of other similar posts to get a better understanding of how the whole thing works.
  • What happens if I don't pay the CCBC?   Have been reading the Newbies section but it's a lot to take in over a few hours .

  • You dont pay the CCBC !  They just handle the first stage paperwork,  you dont pay anyone until a judge tells you to,  that's ages away anyway. That's if it gets that far.
Please take your time and read all paperwork carefully and read the Newbies.   Yes it's a lot to take in but the more you read the easier it will become.
  • so she fills the ccbc forms in and sends them back ?   then wait for a court date
  • Please read the Newbies and then you will have a better idea of what to do and also what not to do.

No, she doesn't.  You both need to read the NEWBIES thread post #2 - she must complete the AOS online to buy a little more time to defend, then read the template defence thread and adapt that defence.

On the date of the infraction she was unable to leave the car park due to a punctured tyre and had to wait fro me to come home from work to go to her aid and change the wheel on her car before she could exit the car park.
OMG she could have had that cancelled at appeal stage or at ANY stage if she'd told them that.  Even when she got their pre action LBCCC letter she could have stopped it by appealing with you as witness about the puncture.  She could also have asked either of the shops to cancel it at any time.

Not now.  It has to be defended properly.

What's the date of issue of the claim form?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
