Thanks again for the guidance. my wife is worrying that she will actually have to appear in court and is now thinking of paying and putting the whole thing behind her. I have tried to explain that if they actually press forward and get a court date she can still bail at the last minute and accept the PCN and pay the money but she wants to know that I am correct can anybody advise her what is the last point in the proceedings she pay and not have to attend court?1

... my wife is worrying that she will actually have to appear in court
There is nothing to worry abour, watch thishttps://www.youtube.com/watch?v=DTCMywJ3lns

It's not Judge Rinder ... nor is it Rumpole of the Bailey. It's as per the video above - essentially a structured conversation. And, of course, you could act for her as her Lay Representative (n court) so that you could present the defence and address questions. (She would still need to attend).Jenni x3

The full balance can be paid anytime up to the hearing
But even a loss in court is less , once the spurious charges are dismissed , so less to pay
Most hearings are by video link or telephone link , not in person , plus you can act as a lay representative as mentioned above , but both of you would be present2 -

Show her your responses to my last post and she is actually a lot happier now .... she even concedes that she could beat them. thanks .2

I think that video posted earlier may be more frightening than comforting to a unsure victim.
I suggest that the following video may more appropriately show the situation in a Small Claims Court...

Hi all - Newbie here (and I have read the Newbie section but cannot find the answer)! I opened a letter yesterday from the County Court Business Centre - couldn't see the name of who it was adressed to (hidden by the envelope), but it transpires it was meant to be sent to our daughter. Appears to be a claim from "Link Partking" for unathorised parking in the block she lived in three years ago which is crazy as she was a resident of the block during the time of the alleged incident (and had a permit)! That said, my query is what should I do now?? Our daughter hasn't lived here for two years and no longer lives in the block of the alleged offence so they obviously haven't done their homework, but I am not keen on having a CCJ further down the line at this address! Any advice on what to do?? Should I call the Business Centre and let them know that they have the wrong address, or tell my daughter (blissfully unaware of any of this) & submit a defence??? All thoughts appreciated!!!!0

Hi, you need to copy and then delete that post as this isn't your thread.
Start a new thread but your daughter MUST acknowledge and defend that claim.
You ignore or delay that by faffing and trying to return it to the CCBC and she gets a CCJ damaging her credit for six years.
Defending does NOT risk a CCJ. She must defend and our forum tells her how.
Please ask a board guide to delete your post as it's currently diverting and hijacking someone's case.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
