    Parking Eye do not issue penalty notices , they issue private parking charge notices , a PCN , an invoice for alleged breach of contract

    The court claim started with the CCBC in Northampton , against the registered keeper , the defendant ! It's too late to name the driver once MCOL is involved

    The AOS is done online by the defendant  at least 5 days after the 8th November , so this weekend or next week ,who should also email a SAR asap to the DPO at parking eye attaching a copy of the claim form as proof of I D under the GDPR law to obtain all their data !

    Your partner is the defendant , so everything is done in their name , nobody else

    No paperwork is filled in or posted by royal mail , everything is done electronically , online and by email

    Follow the instructions given on here , by telling your partner to read the advice and follow it to the letter , no deviations

    If the vehicle is in their name , or was , it's their problem , no matter who was driving , especially if parking eye complied with POFA 2012

     Have been reading the Newbies section but it's a lot to take in over a few hours .

    You need tof ully  understand the process, so spend more hours reading it.  Have you complained to your MP?

    As I see it there are a few possible outcomes from this depending on how strong your case is. But for the record, fighting them in court is NOT something to be afraid of and you will NOT get a CCJ unless you REFUSE to pay them IF you lose in court;

    1. You pay up the £185.
    2. You lose in court and have to pay up about the same amount (as long as you pay, no issue, no CCJ etc).
    3. You win in court and pay nothing.
    4. You produce a decent defence and they pull out before the hearing and you pay nothing.

    All of these are possible scenarios depending on the strength of your case. But hopefully as you will see above, worst case is you lose a couple of hundred quid even if you lose in court. In other words, it's worth following the advice here and putting a defence together...

    I suspect PE will discontinue once they learn about the puncture and see the later witness statements from you and your wife (two witnesses) later in 2022.

    Such a shame this wasn't put to them earlier.  Carry on reading the NEWBIES thread 2nd post and the ParkingEye examples of defences there.

    As it's ParkingEye, this is not a case for the template defence as they don't add false 'debt/admin' costs.

    So after you've got a CC judgement against you.....I was under the impression there is still no law forcing you to pay it.
    And is it true that financial institutions that check credit reference agencies if your applying for mortgage/loan etc can tell if a CC judgement is from a private parking company and usually ignore it, I was told this a few years ago by somebody who worked for Barclays

    You rely too heavily on what is told by others and some of them know nothing at all

    Some lenders might ignore it, others won't.  And a CCJ can be collected by bailiffs so it's not something to be relaxed about.

    However, this OP is not getting a CCJ if they defend and follow our advice at all stages (and don't go moving house and not telling the  court and claimant).  No risk just by defending a claim, not even if you lose as you'd just pay.  No CCJ appears on the register in that scenario so the OP is in capable hands here.

    I obtained a CCJ against a tenant.  He ignored it, AFAIIA he got away with it.

    Private parking companies cant issue bailiffs

    Show me a link that says if you don't pay after county court judgement for private parking invoice that they will come after you
