Received a letter of claim from DCBLegal for a PCN on 16 February 2020.What's been happening during the intervening 3 years?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I received 2 letters from DCB Limited (I think it was) during in 2021. I ignored them.0 -
Do you mean the DCB Legal Letter of Claim has been recently received and relates to a parking charge incurred on 16/02/2020?
DCB Limited letters are immaterial.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

In your reply to their letter before claim, send it in by email just a few days before their 30 days expires.
In your reply, you must question their fake add-ons and in particular their claim for damages.
We have never seen such a response because there is not one. They will ignore that and that is where a judge takes over
Just be aware that the DCBL WILL still try to extort money from hoping you are a mug .... if you get a court claim from DCBL, COME BACK HER and we will help you to get rid of this rubbish.
DCBL has fallen in love with this forum because we save them getting another spanking in court2 -
That is fine as a response to DCBLegal. Don't waste too much time on it . A court claim will follow, regardless.
You will win anyway because after you robustly defend the inevitable claim this year, they'll later discontinue at WS stage.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The two letters from 2021 were from DCB Limited for the same PCN of 16 February 2020. I ignored these two.

@patient_dream
Thanks, will wait a few weeks and then revise my email with those extra questions before sending.
@Coupon-mad
Does a court claim mean you go to court and defend? What is the WS stage?
Edit: Ignore that question, I found what I was looking for. Basically it should never end up in a court right?
Process is- Court claim issued
- Defence completed
- Hearing date given
- Witness Statement deadline dictated by the court
- Phone call from DCB Legal to defendant
- Email to defendant from DCB Legal with 'Without Prejudice Offer to Settle'
- If no response from/refusal by defendant, email from DCB Legal - 'Notification of Discontinuation'
- Confirmation of discontinuation from the court follows

Yes that's pretty much it but you will possibly have to do your WS before they give up (WS stage is explained in the NEWBIES thread).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I received my SAR request back with the dated photos from UKPCL, and the initial PCN letters sent to an address I moved from a week after the incident, so that's why I missed the initial PCN letters in the post in 2020. The photos show the car parked on yellow lines, the parking notice sign states no parking on yellow lines, and the penalty amount for doing so.
What kind of defence/witness statement would need to be produced seeing the car is photographed on the yellow lines.. Am I correct in presuming that if/when DCB Legal decide to discontinue, is it purely because they know they won't be able to get their "admin/scam/wish" fees, but UKPCL can continue to pursue the matter with another company?
I know about the defence template on the other, I am just trying to understand what the defence and witness statement is actually about.
EDIT: Also, the have confirmed they have my old address on file. Must I inform them of the new address?0 -
You must inform them of your current address in case they file a claim. if you don't receive a claim, you are likely to get a CCj by default which is another whole can of worms and work needed to put right.
Just tell them to update their records with your current address and that they are required under GDPR to erase your old address. They will also need to make sure that any agents they have used, such as debt collectors, must also comply and update their records.2
