Hi Everyone, I hope you guys can help me.
I am totally new on this forum, and I have no idea what to do. I have High Court enforcement agent knocking my door from DCBL.he came twice and left notes that he has High Court Writ that has been issued on me and now he is instructing me that goods will be removed from my flat.
I have been issued 3 parking tickets on my private parking (private land) back in August 2019. I didnt have my parking permit displayed on the car, as Direct line insurance came and have changed my screen and at the same time they have collected that permit together with a broken screen. I have called my maitnance company to sent me a new permit. but in a mean time my car park company has issed me with 3 tickets. yes! you are right the same car park company that I pay them in my maitnance fees! So I pay them for my car park, I pay for that land as I am the owner of the flat and still they have managed to give me tickets for my car being park correctly at my allocated parking space, only because I wasn't able to present parking permit.
I have ignored all the correspondences from DCBL but somehow they have managed to get my phone number and Mr Stewart have sent me notes with (these papers attached). And now he is saying that my goods will be removed and that he will place a charge against my flat to the Court which will follow by bankruptcy against me.
Can anyone help me what should I do at this stage?
I have also called the County Court to check if they really issed a Writ of Control as I haven't received any papers from the Court. And looks like they did, the lady have have sent me a copy of Particulars of Claim ( which has got a wrong Post Code! my post code is different to the one on these notes)
I will attached copy of the Writ that enforcement agent has sent me and you will see there is few gramatical mistakes ..things like County Court has been spelt few times with a lower case. that was the reason why I called the Court to check the authority of that photo I have received from enforcement agent.

I haven't been receiving any papers from the Court as looks like they have been sending it to the wrong address

You MUST act quickly.
Chances are this bailiff will be back this weekend, so move your car into a garage (ask a family member) and move it now (right now). Do NOT let the bailiff in.
Apply to stay the execution of the writ and set aside the judgment because the claim was not properly served due to their error in the address.
That stops enforcement and cancels the all the bailiffs fees. The application is made at the High Court district registry that issued the writ. The address can be found on the writ. Complete a Form N244, a witness statement together with a draft order. There is a fee for making the application but if you are on a low income, complete an online court fee remission application.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The debt is £809, the enforcement fee £822. I am sure this is legal, but, even if the CCJ was properly served, is it right?
Have you contacted your conveyancing solicitor? Have you contacted your MP. Have you read these?

Is there a possibility that the original PCNs were not valid, in other words, does your lease give you primacy of contract?
This is far beyond the scope of Chartered Accountants and Char Ladies on an internet forum, you need someone "learned in the law" imo.
It would be absolutely marvellous if you beat that, it could cost the PPC ££££s

You do not need a solicitor to file a N244 on Monday morning at your local court and tell them it involves a stay of a writ so you ask that it is placed before a Judge as soon as one is free.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
