  • Hopefully your conveyancer can clarify when it was submitted. Nothing to worry about as your purchase is protected but you can’t set up an alert for it until it’s registered under it’s own title. You won’t get an alert for example once registered.  
    The one you e just received is for someone else’s plot purchase lodged by their conveyancer so not linked to you 
    I have removed the alert for the developer's title, thank you again for your help.

    Hi, I was just wondering if there was any update for SYK690866 and EEA8AB2.

    Any help is much appreciated.
  • I am in the process of buying an apartment on leasehold. The building is a converted office block. Since having the offer accepted, the developer has sold the freehold to a third party.  My lender's solicitor now says that they cannot complete until the transfer of freehold is registered with the land registry.  My solicitor tells me this can take up to 12 months and that the lenders solicitor is being ludicrous as this is quite common in new build properties and is not a concern. The word back from my broker is that what the lender and their solicitors are stating is correct, it puts the Bank at significant risk if the Freehold title isn’t complete prior to being able to register the leasehold title.  They have suggested the sellers solicitors expedite the registration at Land Registry.  My solicitor is now trying to contact the seller's solicitor to start the process.  In the meantime, I have been on the Land Registry website and found that the buyer can also request that the registration be expedited, which I have done hoping that this might jump-start the process. My question is directed to the Land Registry: How long would the expedited process take? I am at risk of losing the apartment because I have been informed that, even though the developer initiated the sale of the freehold, they may pull this plot sale if the registration takes too long.  Enquiry reference: 211123-005824 Application reference: Title number: NYK451667

    Expedition, if approved, reduces the wait time. So if it were expedited today we’d hope to consider the actual application within the next 10 working days (often sooner)
    However it’s not a magic wand as the registration requirements still have to be met. 
    Looking at the title quoted it’s a busy title which means we have a number of already completed sales waiting to be processed and the freehold transfer you refer to. 
    In order to complete the Transfer we will need to process the earlier applications as well and that may be a time issue re how quickly everything can be done from here. 
    Suggest you wait for the specific response to your request and go from there

  • Hi can anyone help please, we are in the process of purchasing a property it appears that a small portion at the rear of the garden has not been registered. The deeds match the property boundaries but mapsearch is showing that part is not registered. Our fence matches the neighbours in reality and on the deeds but not on mapsearch. Our solicitors tell us that the vendors solicitor is dealing with it but we can't get any answers as to what is being done, is it possible to check with Land Registry that it is being dealt with Thank you

    MapSearch isn’t definitive. It is a tool conveyancers can use to identify a title number for a registered property or see if something is unregistered. 
    The title plan is the key and not MapSearch although you refer to ‘deeds’ so unclear whether you’ve checked the title plan or not. 
    If they’ve raised it with us then ask them for the enquiry reference eg 211123-0123456 as if they’ve got that then you know it’s being dealt with 
    But suggest you check with your conveyancer first re title plan and what that shows as that’s what you are buying, not what’s on MapSearch.

    Thank you, just to clarify does that mean on LR side or with the sellers conveyancer?

    Thank you for your prompt response.  Do you have the application reference for the freehold transfer?  Your expedite team are asking for the specific application number before they can give me a time frame (Not sure why they can't infer from the outstanding applications).  I've asked my solicitor to ask the developer's solicitor for it, but it often takes days to get a response.
