  • I had a demand off equita in December for £200 for a pcn from 2013 - I followed the advice of this forum and sent the relevant replies to equita and parkingeye - I have now had a further reply as below from equita but they are now only asking for £150 - here is the letter from equita

I write further to your recent letter regarding the above and can confirm that we are currently collecting an unpaid parking charge owed to our client parkingeye ltd. The current balance outstanding is £150.00.

A number of letters have been previously issued to yourself by parkingeye to the address provided to us via the dvla.as you have received this notice we would believe that on the balance of probability the other notices should have been received in a normal manner. I can confirm that we do not hold the original notices.

A period of 28 days is provided from the date of the initial PCN to outline any circumstances that are relevant to the charge, inclusive of any evidence that may assist with this. parkingeye can only reject an appeal to POPLA once consideration of an appeal has taken place. As you have not appealed to parkingeye, no POPLA code will be provided as you have not engaged with parkingeye’s appeals process.

There has recently been a case heard by the supreme court between parkingeye and barry beavis. This case centred upon the issues of the enforceability of parking charges and if they are an unenforceable penalty. In this instance judgement was granted to parkingeye. Our charges are in line with bpa guidelines regarding parking charges and are neither extortionate nor unconscionable and are commercial justified.

We can confirm that parkingeye hold full authorisation to manage this car park and to issue and pursue parking charges resulting from breaches of the terms and conditions of the site.

I would urge you to contact our office on 01604 628360 to arrange a suitable payment arrangement.

any further advice would be gratefully received - thanks - colin.

  • Can someone please update me on their situation with equita.

I parked in a car park about a year ago who are run by parking eye, we paid for parking and got back to the car in time but my son who was only a couple of month old needed feeding before I set off so I fed him in the car, and just went over the time, probably by 10 minutes max. I got a letter asking for £60 fine, I wrote back and explained the above and that I would not be paying £60 for feeding my son. My letter was ignored,I received letter after letter asking for payment then I got the threatening letters from other companies and now around a year later, I received this letter from Equita. Exactly the same letter than others have posted on this forum.

I have complained to British parking but I want to know what I should do from here. Continue to ignore or write back to parking eye again. I saw someone write that I shouldn't contact equita which I don't be doing but if someone could update Me on their situation or advise, it'd be much appreciated..

    Thanks

All has gone quiet on the Equita front. Those who came to the forum were advised to ignore them and none have come back to report any further activity, so, based on that, I'd follow suit.

DO NOT ignore a Letter Before Court Claim or real court papers from ParkingEye (who are litigious), but maybe they view your case as too risky to take to court (who knows what goes on in Chorley Towers), but should you get either of these communications, come back to the forum - but please open a new thread of your own.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Very little you can do, the vermin just want your money and are not interested in valid reasons.

Parking Eye and Equita just like most PPC'S are the modern day version of the Kray Brothers.

They may, or may not take you to court and in your defence you can say that Parking Eye ignored you especially as you are mum with a young child. Judges are starting to wake up to these scammers. If you get papers for court, return here for advice and also start a new thread please

Are any of these recent newbie posters talking about charges in Scotland, like this one?

    https://forums.moneysavingexpert.com/discussion/5472246

Should have said, if so. I know the OP Terri Morgan was in England but not sure about the recent posters?
