  • QuentinYou only have 30 days from receiving notice of the change in which to cancel your contract.

    Once the 30 days have passed, then you are seen to have accepted the change.

    I dont understand that. Surely if they have broke the T & C's of the contract I can cancel whenever I want. Why is this not the case?

    No I got nothing in writing, I was kept on being told that I have to pay to leave, Then someone phoned me saying do you want to cancel or want a Pac code, I said Pac code. I was told i should get it in 48 - 72 hours.

    When ever I spoke to Customer service I was told I can't leave without paying 18 month contract.

    When I recieved the PAC code I phoned to see if it is without any fees and was told they didn't send me a PAC code. I told them I received it from them.

    The guy said if you recieved then use it, usually they don't issue it till they get full contract money.

    So I used it and yesterday I got my final bill which stated that I have been disconnected.

    Well I have phoned them, e-mailed them and written to them and have got the same reply...you cannot end this contract because you cancelled the direct debit.
    I wrote, e-mailed and rang again to tell them, I cancelled direct debit as you were taking the money out on the 27th of each month despite the date on the agreement being on or first working day after the 1st of each month.
    Therefore with this and the 08xx palalvar (i.e. them not informing me either by e-mail, letter or text) they have broken the contract not me.

    Got a result today :beer:

    6 months into 18 month contract, phoned O2/CPW, no joy.

    E-mailed and told to write into cancel.

    Sent cancellation for both mine and wife's contracts on Monday and we both got PAC numbers texted to us today

    We went in quite heavy, also citing the fact that not only are they going to charge us for NGN's, but at a higher cost than other networks and also O2 PAYG customers.

    For some reason they also sent us our PAC's twice, they must want rid of us :rotfl:

    Anybody who is with O2 / Carphone Warehouse (CPW) and is having trouble trying to end their contract should write to the High Level Complaints team quoting the relevant contract clauses.

    Use CPW's main address:

    I had this issue put to bed in around 4-5 days when I wrote to this dept.


    I have now used my PAC to port my number to an O2 Online Simplicity tariff.

    Were you sure before you used the PAC that there would be no termination fee on the old contract?
    With O2 simplicity could you in the future get a PAC code to port back to O2 contract?

    CAUTION O2/cpw leavers, make sure to get confirmation of no penalty.

    Do not trust them as 98% of their staff seem to be in denial about them breaking contract terms

    I have twice sent "the letter" with the terms referred to in bold type, and never received a reply of any sort from CPW. After waiting a long time for a response to my email asking what was going on and again quoting 11.5 and 11.5.3, I got a reply apologising........with ........

    "A systems error, however, resulted in your cancellation
    request being logged as an In-Contract disconnection requiring the
    payment of a cessation fee. I have made a note of this error on your account"

    My trust in CPW cs is now zero and I have asked for confirmation that I will not be billed with any fee, due to further "errors".

    There was no mention of a pac being issued, and have asked for clarification on its issue.

    I would guess they ( letter recipient), are reading the first line of the letter only and blindly cancelling causing a fee, so If I were to write again, I would ensure that " without penalty" is on the first line and in bold type.

    If you havent heard, double check, do not assume. I feel this thread is going to go on past the sell-by-date.

  • hi guys, great thread and useful information.

    I am with o2 direct and have been told by cpw 02 that i can switch back to 02 cpw no problems.

    Have requested the pac code from O2 direct and want to order a new phone from CPW 02.

    I hear that orange pay as you go sim is the best way to go, and would ensure that i dont get either 02 quesitoning why i have gone back to 02.

    Where do i get the sim from and can they take a pac code to port the number over?

  • There is still a lot of confusion whether or not you have 30 days from recieving your PAC or 30 days form recieving your first text, can anyone enlighten the situation, I am work at the mo so i cannot ring CPW to find out. My orange PAYG sim is being delivered tomorrow so number probably wont port in time for the 27th but if we have 30 days from PAC code then i have plenty of time. Also when porting its up to CPW when they would like to release the number. so they could just wait until after the 27th and sting everybody porting.
  • If Anyone tells you that you have 30 days from the text then the person is misguiding you.
    You have 30 days to cancel the contract. PAC is one of the method to cancel the contract. it could take some time for O2 to issue PAC and once you give it to another service provider they may take another 5 working days to port your number.
    Having said that it is advisable to take action ASAP. but you have 30 days to use the PAC from the day it issued.
