i plan on sending in the bill dated 28/01/08 thats dated after the 4months from date of connection,
but because i have ported my number i'm gonna have one day to send it off before there imaginary 7/2/08 claim window closes.
I know i will have done it correctly according to the terms and conditions, but i want avoid court in advance,
What should i add to the claim to make it stick?
Should i add a covering letter? what should it say?
quoting the terms and conditions with a copy
highlighting my REAL connection date that will be shown on my first bill.
threaten them with LBA inadvance (what does LBA stand for? :rolleyes: )
anything else? anyone got a good way of wording it or a better idea?

Er... thanks... I think. Actually not much time to "knock about" on here at present.
It's too late to send the December bill even had you decided to play thier game so it now has to be the January bill. Looks like they're counting from the supply date on this one (why be consistent!?) although it's almost unknown to have a conection date a week later than that with them? Anyhow, they seem to have the "correct" dates on your on-line account according to their way of doing things - despite the fact that they ignore the legal t&c. I think the "letter" question depneds on whether you can get the bill to them by their close date. If so, a bland letter quoting your name and address, mobile number etc. If not you could do the same and send a LBA when they reject ALL claims from then or (as they no doubt will). The alternative is state something along the lines... you are sending the first bill which (as in the t&c for your contract) shows that you have been connected for 120 days and they will receive it within one month of its date. You therefore look forward to payment within the timescale set out in the terms and conditions. The point of the letter is two fold; to simply show you have sent the correct bill on time (without saying that antagonistically) in the hope they may think twice before rejecting you (since they don't actually "think" at ALL it's not likely) AND to later show a court that you knew what you were doing and followed the legal t&c you (and THEY) signed up to. The rest (ridiculously and unfair claim window slots in your case in particular by "their" rules) can all come out at that point but not now.
I wouldn't get into their dates etc; they never make it clear that you should see or use them and in any case they appear after the event. The legal t&c are very clear - and were even more so at the time you took out your contract. May as well start drafting your LBA now though - I will be surprised if they see an ounce of sense and simply honour the genuine t&c. LBA is on page two:-

I had a contract taken out on 6th NOV 2007 from onestopphoneshop. This had it’s claim at month 4 (connected 120 days), month 6, month 8, month 10 and month 12.
My bills from O2 :
My first monthly bill was dated 6th NOV 2007 (bill received on 9th NOV, paid through direct debit on 20th NOV)
Second dated 6th DEC 2007 (bill received on 9th DEC, paid on 20th DEC)
Third dated 6th JAN 2008 (bill received on 9th JAN, paid on 20th JAN)
Forth date 6th FEB 2008 (bill received 9th FEB[today], will be paid on 20th FEB)
Fifth will expect at 6th MAR 2008
now i am worried whether i should send the forth of fifth bill as the my claim window date will be between
Send month 4 claim between 4th Mar 2008 and 3rd Apr 2008
if i send the 5th bill which i will get on the 9th MAR 2008, the money will be deducted from my account on 20th MAR 2008. so will i void my cashback my doing this? I dont think they will wait for the money to be deducted. Does this also means I did not fully pay my bill??
if i send the 4th bill (dated 6th Feb) on 4th MARCH, it will be around 26 days and if it is delayed by a day or two, i'll be in a tight situation but at least it is paid.(money collected on 20th Feb)
the latest bill will be in the claim window time frame but its unpaid, not until 20th of that month.
So what should i do?? 4th of 5th bill??

The search facility on MSE appears to have completely packed up for me to day... it couldnt find any threads with "cashback" in the title a few minutes ago... Yeah right!

Payment dates (just like bill niumbers) are completely irrelevant. You do not understand how this works at all. Send the March bill as soon as it arrives and make sure you follow the legal t&c (i.e. the FULL ORIGINAL bill to the CORRECT address). This is the CORRECT answer to your specific question - but dicing with cashback schemes without really understanding them a lot better than this is asking for problems. If you don't know what the legal t&c are you have a lot of reading to do on the numerous threads where this has been covered time and again - including post 5 on my above thread months ago. There is probably some remnant of them on the dealer website if you search around - but they have reverted back to a previous set of t&c for new contracts taken out this year. YOUR t&c are the so-called "price-match" ones - BUT the dates they are following (which you gave) are not consistent. Post 5 referred to on my thread explains all that. The whole thing should be read and followed by anyone who ever thinks about taking out any cashback deal. Caveat emptor otherwise.0

first of all, thank you for the quick reply.
I know what that u stressed the T&C alot. That is why at the beginning itself ( on 6th Nov) i already get myself a pdf copy of their T & C and that is the prove. hopefully. If they change the t&c, i could use that pdf as my evidence. I know u stressed alot of things like posting to the correct address, giving FULL original bills and NOT ONLINE bILLS, get ur bills photocopied before you send, cashback claim form filled correctly. etc. I have taken note of all this and hopefully all goes well for my first time. If it does not, then I am a dead meat and i hate going thru all the hassle of calling and writing to them because in the end it just cost more money and trouble.
by the way,on the cashback form there are 3 particulars to fill namely
1)Transaction number
2) Cashback claimed
3)mobile phone number
for 1) & 3) no problem but what about the 2) which is the cashback claimed??? what do i fill in there??

You pays your money and takes your chances! Lol! As for the hassle don't play their game. Use the legal t&c and go the LBA/sue route if they so desire!
Nothing new under the sun; have answered this one too; "1 £X Month X". I.E. Claim 1, amount claimed this time, claim month 4/6/8/10/12. I would add there is a different description now on their website (IF you can find it) but since you asked me NOT to send you there - I won't!!0 -

Yes, I've seen that recently. However, I stick with my tried and tested way. However, if you print their answer out and keep it you must be covered if they subsequently refuse your claim as a result!0
