VCS do go to court, but the last time they tried it at this site the judge laughed them out of court
"Would you have waived the charge if he broke down"
"Of course"
"Well he says he broke down and I believe him. Case dismissed"
The reason they are not likely to go to court is that it is impossible to enter a contract because at the speeds you go past the signs, you cannot possibly read all the words. If a judge rules against them then the kangaroos court IAS will be stuffed.
Best to head them off at the pass. You can email this to them:
Dear VCS,
I deny any debt exists. Debt collection is therefore not appropriate and will be wasted costs on your part. I deny any contract was in place; the signage can only be read by a stopped vehicle as it contains too many words in too small a font to read fully at road speeds.
This lets them know you are not a soft touch

they have 6 years to take you to court (yes they can and do go to court, no idea who told you they didnt)
so 2 months or 2 years makes no difference
its a speculative invoice and under small claims rules they have 6 years to try to enforce it0 -

there is a little debate on the forum about how to handle PPC's who are aligned to the IPC , the standard forum advice is to do the soft appeal but not bother with the kangaroo court at IAS
my thoughts .......
The scammers that infest some of the smaller airports are in cahoots with said airports as its is a (allegedly) mutual financial arrangement ....
Go back a year or two and you would win this at a POPLA appeal ..... however in the world of PPC's they can create another trade body (the IPC) that have a (again allegedly) kangaroo court :eek: (the IAS) The IAS seem to treat appeals as a lottery 80%+ loose irrespective of the evidence.......
you therefore can (after reading the below) choose to follow the forum advice ,and ignore .... or in IMHO do the appeals as a paper trail.
VCS did try out their first small claims court case over such ....and as predict that they pulled out before the trial ..... . They did not dare try placing this before a real judge! and have not yet tried again ..... I wounder why ?

Cheers for that Link red, I saw the letter Mick Rog posted and mine is the carbon copy word for word so it's pointless posting it again on here.

If you mean an appeal to the IAS then you should now be wise to the fact that you will not (random selection aside) win ...
there are no other templates for an IAS appeal ....
you need to look through the links I gave and search the site for others ..... then adapt them to fit .......

I think he means a letter to VCS, in which case he should search through the sticky threads and the links in them, and/or use the forum search box0

Just a quick update;
I seem to be getting letters quite often now, VCS got a company called ZZPS to contact me saying I need to pay up or else they are getting their own solicitors involved...I ignored and now I have recieved one from their solicitors by the name of Wright Hassell LLP.
Wright Hassell sent me a letter saying that because I'm now a persistant non-payer an extra admin charge has been added (along with the other admin charges) so now my debt with these has risen from £60 to £180.
WH has also warned me in the letter that failure to make the full payment within the next 14 days will result in them passing the matter over to their litigation department, meaning they will lok to obtain a ccj against me and look to recover the debt.
They then go on and list a string of things that will be affected if I do receive a ccj like bad credit ratings or problems obtaining finance etc.
Like I said originally I sent a template letter, saying I was the RK NOT THE DRIVER!
I'm ignoring every letter as I replied with the original template and thats all they're getting, and if it goes to court so be it.0 -
