They also know they can't "seek a CCJ", they'd have to take you to small claims court and win, then you'd have to refuse to pay, then they can apply for a CCJ. They are using the fact you are not legally trained to intimidate you into paying a non-existant debt.

    Then there's also the implication that the letter is actually coming from ZZPS using WH headed paper to look like they are a solicitor, again to intimidate you.

    The SRA probably won't act on your individual case, but they will record it to act if there is a pattern, which is why it's important that you register the complaint so that we can put a stop to ZZPS/WH's abuse of the legal system.

    **UPDATE**

    Just had a letter today from BW legal, here's what they said;

    'Further to our letter dated 1/3/16 (the first letter) where we advised you that we are instructed by VCS to recover the balance in respect of the PCN. In the first letter we requested that you either play the balance in full or provide grounds for disputing the PCN, by the 16/3/16.
    We advise that we are yet to receive payment or a response to the first letter.
    Excel now requires full payment of the balance within 10 days from the date of this letter, this date being 22/04/16, failing which VCS has instructed us to commence county court proceedings against you for recovery of the balance. For the avoidance of doubt the balance relates to the £154.00 parking charge and the £54.00 for VCS legal fees, which were detailed in the car park terms and conditions.

    County Court Proceedings;

    In the event VCS issues County Court Proceedings, and successfully obtains a CCJ, YOU WILL be likely liable for the balance, court fees, further solicitors costs and statutory interest. Furthermore this will also result in a CCJ being entered against you.
    VCS also reserves the right to commence enforcement proceedings against you for recovery of the CCJ award.

    We also wish to bring to your attention the case of parkingeye ltd v Beavis 2015 uksc67IN which the supreme court held that Parking charges serve a legitimate commercial interest and are neither extravagant nor unconscionable. This case eliminates the main defence that you will have should the matter go to court and will be relied upon, by VCS, in any court proceedings.

    You should also note that if your claim has already been processed through an Independent Appeal Service (IAS) and an IAS has dismissed your appeal, then it is likely that a County Court will come to a similar conclusion and you defense will be unsuccessful.'


    First of all what I'd like to know is what happened to Wright Hassell, and why has this new company taking over matters?

    Do I still ignore, they have somehow tried to call me on my number too god knows how they obtained that but that was dealt with in a certain way.

    Thoughts re BW legal?

    1) no idea, only VCS/EXCEL , WH and BW LEGAL could tell you that , but probably wont

    we certainly cannot tell you

    2) your choice , we would say yes , IGNORE but its the same advice as ever, dont IGNORE any LBC or any MCOL

    3) put BW LEGAL into the search box and read all the recent advice given to everyone else that has posted the same questions and who have asked about BW LEGAL this year

    It's likely nothing more than another debt collector letter ... check the wording.
    In the event VCS issues County Court Proceedings

    YOU WILL be likely liable

    However you could treat it as a Letter Before Claim and respond accordingly. Follow Redx's advice above.

    Works far better than staying isolated on your own thread, every time.

    There is always loads to see on other threads, just waiting for you to search & find them, and when you get a 'new' letter, you can bet it's been seen before and lots of advice is already here for you.
