PCN for Liverpool Airport

Hi

I'm a newbie and this is my first post (on any forum) so please be patient with me. My Father has received a PCN and asked for my help in making an appeal. Luckily I found this site first as otherwise we would've done everything wrong!
We intend to use the template letter from the "Newbies" post but would just like to check a couple of things first relating to his personal circumstances.
My father is a taxi driver (private hire not black cab) and the PCN he received is for a drop off he made at Liverpool airport during the Christmas holidays. (He doesn't usually do airport runs and won't be doing again).
What I'd like to ask is -
1) as his car is used as a taxi, can he still put the bit where he says he's the keeper but does not admit to being the driver?
2) as the PCN relates to him stopping on the road - rather than being in the car park should the wording still be the same?
I would be really grateful for any advice. Thanks in advance

    yes

he may not be the RK (if its leased or hired etc)

but he is "the keeper" (even though you or me could have been the driver)

use the wording "as is" as long as its done as keeper

they will reject it, then its a waste of time appeal to the IAS, or ignore , or both

the site will be on tv in a couple of months, on ripoff britain

Wednesday the 14th January to be precise....

It would also be of interest to search the forum for John Lenon Airport for other instances of this rip off.......

How can you be charged for parking when you only stopped ?????

This was winnable under the BPA but not they have jumped ship the the mysterious kangaroo court of the IAS

I think the 'win' might be the prospect of pushing VCS to the small claims court where their business model and the collusion of the IPC/IAS is exposed - especially the 'not relevant land' aspect at JLA

I've yet to see any VCS/JLA PCN end up 'in court` let's see if they are any braver in putting this in front of a Judge with IPC backing than they (never) were before with the BPA in their corner!

  • Thanks for the reply Redx.
My Dad is the registered keeper (it is his car). My point was more that he might not be able to say someone else was the driver because of it being used as a taxi.
Does this firm always reject appeals? And what will that mean for us? I take it my best action is still to make this first appeal all the same.
Sorry for all the questions just want to do the right thing for my Dad. He doesn't want to end up paying the £100 or even more!
    Thanks again

yes he should appeal as keeper - use the template "as is"

I would say I am 99% sure the appeal will be rejected with 21 days to appeal to the IPC (which is usually a waste of time now)

as RK he could claim not keeper related as its not relevant land under POFA 2012

assuming all this fails, he could ignore the debt collector letters for 6 years, unless he gets an LBC or MCOL for the SCC

VCS have taken people to court, and lost , but who knows on the day ?

    Hi all,
thanks for the info regarding the programme, we'll watch with interest.

    Ralph,
The reason given by CVS is "Stopping on a roadway where stopping is prohibited". A photograph of his stopped car is included. Something which is apparently quite common for this airport?

So they have admitted he wasn't parked. I bet there is no mention of that anywhere on any of their signs. Appeal to the PPC and then ignore everything else or appeal to IPC then ignore unless you get real court papers. If the PPC were stupid enough to pursue this to court they would lose.

How did they get the keeper details?

Putting aside the question of whether the site is covered by byelaws rather than POFA, the use of POFA to get keeper details only applies for parking "offences" ... stopping is not parking. :)
  • the firm who runs the rip off at liverpool airport is expanding its scope. i got an 'invoice' for £100 the other day for stopping on a road about a mile away from the airport but on the same site. i stopped on an obsolete slip road with no markings or signs by the QUBE and prinovis and still got one. obviously they must need the money but are just driving people away. maybe they have an agenda to have JLA closed down and everyone use sheffield airport.
