Labrador mad, try and have a read through the many threads on JLA to see a full picture of this scam.
It would take a fair bit of typing to list all the faults / contraventions / and down right illegality that this company are implicit in ...... Umkomaas, Redx and Fruitcake have listed just a few.

When you have read through some of the threads you may feel like complaining to the DVLA as they are breaching data protection !

I amongst many others are doing such.

So sorry for the delay in replying but your help is very much appreciated Ralph :D

We've sent the appeal letter from the newbie thread to VCS and await their reply (rejection) with baited breath.

In the mean time we'd like to complain to the DVLA. I've read about it in the newbie thread and will use the address posted there for my complaint to the DVLA. I'd be grateful for any advice you can give as regards to the wording. I want to sound like I know what I'm talking about so it is taken seriously ;)

    Thanks again

Wait until you get rejected at IAS stage by the smarmy git. Then complain to the DVLA, as is discussed in links in post #3 of the newbies thread about the IAS and how useless it is as an 'ADR'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Right oh, will do. I Wasn't sure at which point to complain to the DVLA tbh. Just know from what I've read on here that CVS didn't really have any justification for asking for the keeper's details and the DVLA certainly shouldn't have given them out.

Me and Dad want to add our voice by complaining to the DVLA - and going through the motions with IAS - as it is the only real way we can contribute to help others.

Again I can't say how much your help is appreciated :)

Same goes for everyone who has taken the time to read my post and offer valuable advice :D
  • Hi all,

Well my Dad finally got his expected appeal rejection today (day 27 of the 28 they gave themselves to reply in).

I don't have the letter here but Dad read it to me over the phone. It sounds just like others I've read on here -

"Proceeding on the reasonable assumption he was the driver"
"Now is not the time to deal with the other points you've raised"

Really don't know what gives them the nerve to make either statement. Plus there's the if you make any further appeals you have to pay the higher amount - just to scare people into paying.

Anyway that aside I'd like some advice re appealing to IAS, what points to raise etc. He can't fight it on not being the driver but I know there are other points.

Dad did see his MP about it who said they were going to write to VCS - but that obviously didn't carry any weight. Dad is going to make an appointment to see them again with his rejection letter - it may not help but at least it may raise awareness.

Any advice would really be appreciated.

    Thanks in advance

HI, have a look through the 'newbies' thread/sticky here ....

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163&order=desc

there is a section on the kangaroo court that is IAS.

The current forum census is to appeal to the IAS even though they refuse the vast majority so your complaint can form part of the evidence that is building up against them, secondly it any thing did get to court it would show willingness on your part. (some forum members may wish to suggest a different action)

Sorry I missed your last post re the DVLA

I have included my current thread re my complaint to them below. There are many more ... probably better if you search the forum with DVLA complaints.

There is / has been some form momentum on the car parking (cowboy) industry with some MP's rags like the daily Mail taking an issue , so yes please do your bit.

Well we've now at the point where dad is getting letters from a debt collector - Rossendales. I had a look through the threads and I know many advise ignoring them as they are totally toothless. This doesn't sit very well with Dad - its hard work just stopping him from phoning them! So we decided to instead email them.

I found a template letter from zzzLazydaisy (sorry I don't know how to link to it) -

    Name
    Address

    Date

    Dear Sirs

    Parking Charge Number xxxxx

I refer to your letter of [insert date], and earlier correspondence.

Firstly, I have no intention of paying the money demanded by your client, and any court proceedings will be vigorously defended.

Second, should it be your client's intention to start court proceedings, they must provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:

(link removed as won't let me post with it)

Please also note that a failure and/or refusal to comply with the Practice Direction will result in a complaint being made to the court and an application for a stay of the action and costs pursuant to the provisions of paragraph 4 of the Practice Direction on non-compliance and sanctions.

In the meantime, you should note that this charge is disputed, and you must now refer this matter back to your client and cease and desist all further contact with me. Failure to do so will result in a complaint to the Credit Services Association.

I trust that I have made myself clear.

    Yours faithfully

I just wanted to check this is still correct as Daisy originally posted this in 2013. Also would it be ok for me to add something about harassment? - Dad really wants to make this point. He is not exactly upset but does get wound up about it- something he is very much supposed to be avoiding.
Although I know they can't actually do anything, is there any likelihood of anyone turning up at Dad's house? The reason for asking is that although Dad knows to tell them to "sling their hook" he is worried about someone turning up when he's not there as my elderly grandmother lives with them and could easily be upset and be taken advantage of.

As always I am very grateful for your continued patience and any advise.

They are greedy money obsessed bullies it will not make a shred of difference, in fact they will probably just send more rubbish letters thinking they have hooked you in.

I totally agree with both the above posters

    And would add

NEVER phone a debt collection agency (or a parking company for that matter)

Print all responses to your plan to email them and show them to your Dad
