PPI Reclaiming successes and failures

    Afternoon All just been off the phone with halifax asking for an update on my ppi ,the woman that i spoke to said nothing has happened on the complaint and they have 8 weeks to respond . but informed her the 8 weeks is up on monday,they will send letter if they can't close the matter within the 8 weeks. just wondering if anyone else has had the same dealings with halifax. What should be my next step

    I have recieved the following:

    Dear Mr XXXXXX
    Thank you for your recent letter received by us on 29th January 2010.
    It is important that we are made aware of any instances where our customers feel that their Payment Protection Insurance has been mis-sold so I have fully investigated the issue that you have raised.
    Having considered the information that you have provided, we are unable to find any evidence to support your allegations that the policy was mis-sold. We believe the sale of this policy met our own high standards and those set out by the Regulator. However, we are sympathetic to our customer’s personal circumstances and therefore , purley as a gesture of goodwill and in the interest of bringing this matter to a conclusion, we are prepared to cancel the insurance and credit the agreement with all sums that have been paid towards the insurance. Furthermore, we are willing to pay statutory interest on each payment made calculated out at 8% simple from the date that each payment was made until the statutory interest is paid, which is in line with the award made by the FOS in such cases.
    Which is £1115.98 + £117.05 (Interest)
    Why have they got to pay it back into the agreement? is this fact?

    Can I ask for them to send me the money in a cheque?

    Any advise would be greatly recieved!

    Hi Stuart, as this is a goodwill gesture and not admitting liability then you can "ask" that they pay over to you all the repayments that you have already made to date for the PPI (which is like what FOS would do) and 8% statutory interest made on each one from the date each repayment was made and then the remaining PPI be taken from the loan (which again is what FOS would do)and a new loan drawn up to reflect this with lower repayments. They can say no to you as this is goodwill but you can only but ask. I would add in the letter that you have been deprived of using the money that you paid over in PPI and you should be allowed to use it now as you wish. Also you still have the option of going to FOS with the complaint and you could perhaps add that too.

  • I got 2 responses today from littlewoods ans studio. Studio added a bit on to end of my statement hich has a zero balance to say if I've a problem to contact them to discuss it but they will happily give me ombudsmen info if required. I think they are trying to put me off. Maybe I should've added in my first letter you can never get through on the phones and when I have the person on the other end couldn't understand me. Got a bit angry when I read that. They couldn't even reply in a letter instead writing a paragraph on a statement!

    Littlewoods - god knows what they are all about. I got a letter that wasn't even typed properly or signed! It simply thanked me for contacting in relation to a copy of their policy document for their extra care advantage plus and enclosed a copy of the policy. It then says its important I read this information carefully. Thats it. lol. It doesn't answer anything I asked or stated in the first letter I wrote. I'm bit confused. :(

    Hi there

    Personally I would request for all correspondence to be in writing, as you may require these to support your case, if you go to the FOS etc.
    So ask them to only deal in writing only, just in case they try fobbing you off as well.

    Write back to Littlewoods, tell them your not happy with the response and you expect to receive a full response in regards of your letter, tell them there are errors and not a lot to go by.
    Have they actually supplied you with the agreement?

  • Does anyone have any experiences of going to court to reclaim credit card fees/PPI?
    I have claimed £1020 from Barclaycard via Moneyclaim Online (MCOL) on behalf of my Dad. They have said they will defend using Simmons & Simmons solicitors.
    I have a good case for mis-selling of PPI (self-employed, pre-existing medical condition) and have decided to reclaim the fees as well.
    Identical claims from Sainsbury's and Abbey (see below) have resulted in full repayment with interest after I rejected a partial offer. No hassle really.
    Barclaycard are proving more difficult however, they sent two letters saying it was being dealt with and that they would reply by a certain date. They missed both their self-imposed deadlines, the last being Dec 4th '09.
    Any help, advice or anecdotal evidence would be much appreciated.

    How long did it take for Littlewoods to respond to your complaint? I sent them a letter 2 weeks ago as i noticed when going through some old statements I had been paying Extra Care Advantage for 3 years!!! havent heard anything back yet. I have heard though that Littlewoods just reject the complaints!!

    No they sent me a booklet all about their extra care through the post with their half written letter. I have never signed anything about it either. I'm really not happy with their response, I just wanted to say bout it here to see what others though because I was kinda dumb struck lol
    Thanks for the advive Di. I'm thinking I'll either call and ask for account info to be sent out and see what they say but also put it in writing to them stating time i called etc. What u think?

    I sent my letter off 2nd class recorded on friday and got the response this morning. They clearly haven't read my letter. It states in the back of the wee booklet they decided to send me regardin the extra care cover at the back that they will respond within 5 days so I would get back on to them if I were you. They seem to be claiming within their booklet that the cover includes life insurance n such like through norwich union.....I hadn't a clue that I had life insurance through this with them. What bugs me more is I've heard of life insurance policies being invalid because the person has too many covers etc etc whether thats true or not I don't know but I have all the cover I need. I asked for them to cancel this in my letter as I was not happy at paying it.....so they send me their booklet instructing me to read it carefully!
