    What were you reclaiming: PPI on Credit Card
    Who was the provider: EGG

    I have tried to claim for the misselling of PPI on my credit card with Egg from 2001, they refused so referred it to the FOS. I Received a letter from FOS today not upholding my claim!! To sum it up they say that "it is clear from the evidence from Egg that I was presented with three choices, which were to opt to take the cover for myself, for my partner or to decline cover, which I apparently chose to take out the cover (This would have been a Pre ticked box) The terms and conditions were online which I ticked to say I had read it. They say that although I had pre exhisting conditions it was up to me to check for exclusions. "Furthermore, it is evident that you had to act positively by selecting an option on the application to take out the policy." Cost of the cover was clearly shown on the online application and would have also been on the monthly statements. You commented that you were unaware that you had the policy until Egg sent your statements, however I can not conseder this point as your statements were available to view online (I never checked and I could not as I did not know my log in details)

    Hope that makes sense as I have tried to shorten it. I am so dissappointed!

    Oh dear..........I am so sorry to hear this.

    I would ask them to reconsider, and tell them your reasons, I'm sure you can ask for another opinion by another Adjudicator, ask them and see if they can do this for you.;)

    Hi all

    I thought I would list the points raised by tesco in their failure to uphold my complaint-

    1)there is no evidence to suggest that you were incorrectly told that you must take the policy to be sucessful in your application for the card. you have ticked the box on the credit card application form where it states blah blah blah. We strongly recommend you take out this cover. Tick box.
    2) PPI reference to cancellation policy
    3) As th epolicy was provided on a non advice basis , no assessment of your circumstances or existing cover was appropriate. Full details were included in the policy document to enable you to make an informed decision for yourself.

    I don't know why I should be worried having sucessful won against B Card and FirstPlus, but this worries me a bit. In the first point they are wrong because I never referred to the point about taking out the policyy to get the card.

    Can anyone here please tell me if they have had a similar letter, complained and then won? I intend sending off Martins letter no 2 but some confidence boosting advice would be appreciated.

    Yes do write to them again, tell them you would like them to reconsider, due to the fact that you "were mis sold" with the reasons you gave them on your first letter.

    This response is one of the standard fob off letters, you still have your reasons, keep fighting them, if they don't resolve then I'm sure the FOS will.

    Anyway, many used to think it was all part of the policy with not being told any different, it may have been the same for you as well.
    I used to think it was all in sort of thing, and assumed if cancelled then I would have to pay everything back.

    But do keep on at them, tell them you do not agree with their decision.

    In the template letter 2, I would try to change to your own words as well if you can, on every reason they fobbed you off then give yours, tell them you assumed it was all part of being accepted of the finance, because you were not told different, advised or not advised, they did still have a responsibility as a bank worker to make sure you would be eligible in the first place.;)

    I am writing in response to your letter dated xxxxxxxx, with regards the insurance sold with my credit card. Your reference is xxxxxxxx.

    I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.

    I would add that as a regular customer of Tesco, both in retail and using your insurance products, this is not the sort of treatment that I expect to receive. Not only have you used every excuse going to delay your response to my original letters, as a responsible lender you have a duty to provide clear and concise information, explaining it without jargon in order that the man in the street can understand

    As an example, you have implied in your response that I applied for PPI in order to be successful in my application for the card. You ‘strongly recommend’ on the form so you say, that I take out this cover. Please advise where in my original letter that I have made the point about this? If anything your form implies that I have to with the wording previously referred to above. I would also add that I am not actually sure whether I did tick any box relating to this; however this would be subject to further investigation by the relevant authorities. This I believe would not be in the best interest of either party.

    You are also wrong to imply that ‘no assessment of my circumstances or cover was appropriate’. This cannot be true as you asked no questions of my health at the time or if I knew of any impending unemployment. Surely any financial institution selling insurance would have to determine these relevant facts?

    It is clear from this last point that you have clearly ignored the salient points of my letter and therefore should you fail to uphold my complaint, I will refer this to the Financial Ombudsman Service who, on the evidence of the foregoing, will agree with me and uphold my complaint.

    Your full and immediate response within 14 days is required to prevent further action.

  • thx for reply ppi rebate was £7301 they have confirmed that i will get £8320 not bad for a template letter cant thank this site enough
  • I was browsing this site and saw the topic about reclaiming PPI premiums, so thought I'd give it a go, thinking that I would qualify for a refund due to being told that I couldn't take out the loan without the insurance. I thought this was a little odd at the time as was/am in full time employment, with very little chance of being made redundant and in full receipt of sick pay/leave etc. Unfortunately, I was in the position at the time, where for some inexplicable reason, they were the only provider prepared to give me a loan.

    The loan was taken out with Egg in Oct 2004.

    I used the template letter to contact Egg on 3rd December 09. I received a reply from them dated 14th December, acknowledging my complaint. I thought no more of it over the Christmas period. On checking my bank account however, on 26 December, I was very surprised to find that my account had been accredited with just over £3145 on 22 December! A delayed letter then arrived afterwards, dated 22 December informing me of the refund.

    I would urge anybody in the same position to submit a claim, particularly if they have a financial product with Egg. For the price of a 1st Class Recorded Delivery letter and a few minutes cutting and pasting of the template letter, the possible benefit obviously far outweighs the miniscule cost!
