    Just to keep everyone up to date and to thank everyone for all their help :)

    I am helping a friend (who now owes me a beer or two!).

    So far;

    A&L Loan - 2995.49
    A&L Loan - 1410.87
    Egg Loan - 1210.97
    Egg CC - 597.73
    MBNA Visa - 570 (but hopefully get interest to)
    Northern Rock - 2546.98

    Total = 9332.04!!!!!!!!!!!!!!!!!!!!!:rotfl:

    Awaiting;

    MBNA Mastercard
    Barclaycard

    I wish i had agreed to get 10% now!!!! haha

    Only problem is my other friends want help now :eek:

    Thanks for the link. I have read all that and still can't seem to find the right reason. As I applied by post then I must either have ticked the ppi box or it wasn't there at all. (Can't remember that far back!). I do know there was definately no way it could have been explained to me though.Any additional help (especially from successful Barclaycarders) would be greatly appreciated!

    Not a problem.;)

    Have you thought about requesting a Subject Access Request (SAR)?
    With this request they should send you everything they hold on you, this should also include transcripts of phone calls etc, and loans taken and so on.
    They have 40 days to comply, link below to SAR letter, you have to enclose £10 postal order or cheque payment for this request, post by recorded delivery - this is your proof of posting.

    Hi, if you applied by post then there is a chance you did not tick the box and they did it for you:rolleyes: out of the goodness of their hearts. IF you did tick it though yourself then this would be classed as non advised if no-one actually spoke to you about it and they would usually say they sent all the documents for you to read and you agreed to it. Like I say though there is a chance this did not happen. You need to get the SAR as this would perhaps have details for you to know for sure.

    Who was the provider: Egg
    How much did you get back: 5000
    Did you get it back after a letter or did you go to the Financial Ombudsman: First template letter.
    And then write your brief reclaim tale

    Further to my post re successful claim yesterday I have received a phone call from egg today telling me that they are refunding my PPI on loan with contractual interest. The refund is being made to my bank account. Many thanks for your assistance.

    Listen I know its getting late, but would you please check out this template letter I have amended and let me know if it will work please-

    I refer to default charges applied to my account amounting to £372 exclusive of interest, which I have requested you pay back.

    I wrote to you on 9th November 2009 making the original request for a payment in settlement of my claim. As I have not received a satisfactory response, in other words your offer dated 13th November 2009 is unacceptable, I am writing to inform you that I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the Her Majesty’s Court Service online.

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour. As I am sure you are aware, the Office of Fair Trading also stated in its April 2006 statement into credit card charges that it considers charges are at a higher level than is legally fair, despite the contradiction in your letter.

    I have attached as a reminder, a full schedule of the charges with this letter.

    Without prejudice


    The charges and interest I have claimed above total £ 457.89 and therefore within 14 days of the date of this letter (and, for such purpose, time shall be of the essence), I expect a full refund to negate the need for court action. In addition to this, I expect to receive a refund by cheque and not by way of refund to my account due to a period of financial hardship. I would add that the charges have contributed to my current position and therefore to prevent any involvement from the Financial Ombudsman, please ensure that my instructions are followed.



    I look forward to a full response to this letter within 14 days; otherwise I will commence court proceedings to reclaim my money.

    I will post it tomorrow, but this is in response to a previuos post onf mine whereby Mint only offered me £76. Everyone here told me to go for it so I thought what the heck lets try for a direct refund too.

    Any comments?
