    Letter from Bank

Well, I wasn't sure but tried it anyway! Dead chuffed my bank have been so gracious!

I wasn't sure because Lloyds don't call it PPI, I thought it'd be worth sending off the mis-sold letter anyway. I did actually try to cancel the insurance 2 years ago but was told that was not possible!

I explained all this over the telephone after my letter.

I only sent one letter, the one from the site. I recieved a call 2 weeks after this explaining it was going to take some time. 1 Month passed and I recieved another letter telling me there was still an investigation going on. Finally after a full 8 weeks I recieved a letter yesterday offering me £780.....

Thanks very to Martin and everyone at MoneySavingExpert.com:money:

I have received a call from the FSO today regarding a loan I took with the HSBC, back in December 2005. The HSBC, never replied to my second letter, which is the reason I then went to the FSO. They have advised me today that they have received an e-mail from HSBC, stating that they uphold my complaint,(horrraaayyyy) and that they will refund my insurance payments plus 8% and re-schedule the loan. I have not received notification from the HSBC, regarding their offer (which I find v.odd). I have asked the FSO lady, who was very friendly and easy to deal with, whether the refund is taken from the loan, and if the loan is rescheduled is it a the current APR, or the APR, from when the loan was taken out. She has advised that she will contact them for me to establish this, but seemed to be of the opinion that it should be at the original APR, can anyone clarify this please? I will keep any updates posted, and for those considering going through the FSO, I would urge them to do so. It has taken a couple of months but I don't think that I would have received this result on my own.

Well further to my previous post. I have now received my offer from the HSBC in black and white, and have several calls to make an appointment to reshedule my loan, and then follow up calls to make sure the branch in question had made the appointment.:T Amazing how on the on the ball they become when the FSO get involved!!!!

I would just like to know if anyone out there has bee through the experience of having the remainder of their loan recalculated, and how this is all worked out?

In advance many thanks to anyone who can help.

Have achieved a major success for my sister-in-law on her PPI for M & S & More card. After 2 letters disputing that she had ever asked for PPi to be added, they have credited back to her account £2051 covering last 3 years of premium! Although they argued it was shown on her statement each month, as she had run up debt to her limit her concern was meeting monthly payments rather than detail. They also admitted they could not find her original application form so that helped too.
We used amended versions of the template letters, so keep trying everyone!

  • I have received a cheque from Abbey for £6166.11 covering insurance premiums and lost interest, that was not requested on an internet application for a personal loan through Cahoot on January 2003. It took one letter, one standard Abbey form plus a phone call and took 8 weeks to resolve.

The original application on the web was for a personal loan that did not include any insurance. In addition an application form was returned to Cahoot and the tick box for insurance cover was left blank. I took a photocopy of the original form as returned to them. There was no need for insurance as I am self employed. Never got any statement from them as my email address changed around the same time and had not realised that they were communicating statements in this form. They made no effort to make alternative communications. I used your template letter, suitably modified. They replied quickly with a standard form to fill in, however I found most of the questions did not apply so gave them a phone call. They kept me informed of progress and eventually upheld my claim.

Thank you Martin for highlighting this problem and the advise for getting justice.

Hi there. I'm sorting out reclaims for my Dad and he has just had the same letter from Egg. As I recall when he made the application online, he had to tick the PPI box for the application to continue.

However, Egg say that the PPI is clearly optional, and has never been marketed as a condition of getting the credit.

This is their final response, so I guess its off to the Ombudsman now

I had the same problem and I sent off my letter to the FOS.....the result is that apparently the tick box on the internet site for EGG when you apply online is not defaulted to stay ticked, so in efect if you DO NOT want PPI you should ensure you mistick the box. The FOS have said that they therefore stand by EGGs decision not to refund PPI. I could argue this in court but to be honest I have several other court summons in place with other companies that I just can't be bothered to take EGG down that road...too tired now!

So what I am saying is that forget about going to the FOS about EGG credit card applications online....You just won't win.

    SORRY!

Very well done on your win. Can i ask what year your loan was and where you told if you did not take ppi you would not be eligible for the loan. What did you say in your letter if you dont mind me asking? I am having a nightmare with them at the moment.
    Again well done

Well done you. Any tips? I've had their 'we're looking into it for you' letter as of 3 April, but not heard anything since. At least it wasn't a 'get lost' straight away! Mine's a classic mis-selling claim - any tips, details or advice you can pass on as you seem to have had an easy ride with them. Thx.
    Successes so far::j

  • I_Norfolk - How did you say your PPI was mis-sold? Mine was just a bit dodgy - they calculated that my debt repayments would be cheaper with my low rate loan, then told me my monthly payments would be £140 a month. Only two years later have I realised the two figures don't add up. I signed up for insurance thinking it much less than it is because they didn't give me a break down. It's a bit confusing. Anyway, they're not budging for me. I've just had my second letter back.
  • Anyone had any success with Direct Auto Finance/Yes Car? I ve just received their standard reply to my first letter. Now ready to send 2nd letter and threaten court action.
Noticed on main site many members in same position. Any updates would be appreciated. Thanks.
