A contributor to this forum, won his PPI case against Capital One. As the debt had been sold onto a dca, Cap One were going to send the money to the dca, but the claimant wrote back to Capital One, arguing that because the PPI charges were added to his card, unfairly; thereby exceeding his credit limit - Cap One ought to send him a cheque. Which they did.

:T As a self employed person I read with interest the procedure for reclaiming PPI on loans. I decided to follow Martin's guidance on this website re PPI letters on a loan I have had for over 4 years - (another 2 years to go before completion) I complained to the loan company in March. Having heard nothing from loan company for 8 weeks I phoned them and asked what was happening re my complaint before going to the Financial Ombudsman.
I received a letter the next day saying that the PP insurance was to be refunded in full as I should not have been sold it in the first place, AND I would be receiving interest payable on the refund - total refund just over £4,000 taken straight off loan - !!! Total now outstanding on loan is £32 which I have just paid off. RESULT - NO LOAN !!
Cannot thank Martin and his website enough - starting to sleep at night again now !
Message to others considering reclaiming? - try it - hopefully it will work for you too. Good luck.....

I received a phone call from the Alliance and Leicester about 3 weeks ago giving me information on two loans I had taken out in 2005-2006 & 2006 -2007 saying they might have wrongly took PPI from me. A week later I received a letter with an offer for each loan totalling just over £1400. They did state that it would be paid by cheque if I accpeted this 'full and final offer' so I called them asking why pay by cheque when my account with them is still active and you admit to wrongly taking money from me for the 3 years I had the loan? They replied it is company policy (same old story) and I would have to write in to accept and receive the cheques. Asking how long it would take I was informed 6 weeks, however I completed the acceptance form immediately, popped it in the post and the cheques came to me 2 weeks later:T (last Friday to be exact). I went to the local A & L to pay it in and they said it would take 5 working days to clear!!
Asking why when it was money from A & L to an A & L account I was again informed it was standard clearance time?? 5 weeks + 1 weeks clearing is a long time and more interest for them that I should have been getting . I am glad that I didn't claim for my bank charges before, even though I have completed the letters from this site, I thought I would hold off. I am amazed at how easy it was, and they contacted me:D ?
My friend is now contacting them to see what he can get back. Hope others get a good response.0 -

Well I got two cheques from Firstplus today in settlement of my claim via the FOS. Whoopee! I am going to Spain on tuesday for my niece's wedding and this means I can now relax a bit. It also means I can now get her a gift, this means so much to me. Thank you to everyone who has given me advice, this site is fanatastic. But I would also like to say what brilliant service from the FOS. I only referred my claim to them in March 09.

Hi there
And WOW what a letter......
Now as your case is with the FOS are you aware if this is with an Adjudicator yet?
If so then personally I would let them know about this letter, it may be the case that they have already received a copy as well, but in my opinion I would contact the FOS if this has not been passed on to your knowledge and ask first.
I did not know about one of mine until weeks later that it was passed on, it was only because I made contact with them.
What do you think of this?
Are you happy with this letter and the way they have dealt with this?
So they are saying they will reduce your loan out of the PPI repayments, but you will still pay the same, but yet the loan will finish at an earlier date? Where you will not actually receive a refund as such paid directly to you?
As they are reducing this from the full loan amount?
The choice is yours, if your happy then obviously let the FOS know as well, so they can close the case and move on to the next one.:D;)XX
Good luck hunni and well done.;)
PS, just to add that do not worry about the "optional" in the small print, what they have stated is just a standard response.
On mine with a credit card PPI with lloyds, I signed the agreement, and the copy I received shows a automated cross done by them, it was a matter of a direct sale, quickly sign here !!!
Probably why the banks are loosing money, because every job is done more than once!
Can't beat a well run office!:rolleyes:Never skimp on Shoes,Tea bags and fishing tackle!0
