PPI Reclaiming successes and failures

Also Aligerdie, did you sign the settlement form from Cap One, stating you accept the settlement, ' without prejudice?'.
Many thanks.
Hi,
Sorry I didn't reply sooner, I've only just seen your post.
It didn't go as far as the FOS, they sent me the usual Cap1 fob off letter initially, so I had to send the 2nd one threatening the FOS.
I didn't sign the settlement form straight away, I wrote first stating that I wanted the premiums refunded by cheque rather than off the balance.
Once they wrote back confirming they would do this, I signed the form and sent it back. I didn't mark 'without prejudice' on the form as I was happy with the amount offered (only £30 less than I thought it would be).
Cap1 try fobbing you off first. They have done with my ppi reclaim, and my credit charges reclaim aswell. You have to persevere, and this has resulted in me having refunds by cheque for both, rather than them notifying the dca to reduce the balance (which realistically would never have happened!!)

Hi there funky
Please remind us did you request for the statements by requesting a SAR?
If so they must comply with that, as there is a payment of £10 which they should return to you as well if they cannot supply anything to you, they have 40 days to comply with this request.
If not this may be the only way you will receive your documents/statements etc is by requesting for the SAR.;)
Let us know and we shall take it from there, cheers. XThe one and only "Dizzy Di"0 -
Hi, am new to this so please bear with me if I ramble a bit.My hubby and I paid off a very large loan in 2007 after only having it for just over two years. The PPI paid was approx sixteen thousand pounds. It was all arranged through Freedom Finance and money paid subsequently by Karacus Ltd. We sent off first letter to Freedom 8 weeks ago and got first response after two weeks stating would investigate and contact us by 10th June. Received letter today stating that they have recording of telephone call and that it was pointed out PPi was optional and that we had 30 days to cancel. They also pointed out to us that we have had four years of benefits of PPI - so they obviously don't realise that we paid this off in full two years ago. Are we entitled to have a copy of telephone conversation as what they are stating is not quite how we remeber it as at the time we were of the understanding that if we did not take PPi we would not get the loan. I work for the NHS and hubby is in armed forces so we are both well covered for sick pay etc. They have offered us a goodwill gesture of £1000 on the proviso that we take this no further. I am inclined to accept this with summer holidays coming up but hubby feels that if they were 100% sure that we have no legal standing they would not be offering us this goodwill gesture. Would greatly appreciate any advice or opinions. Many thanks in advance.0

Hi and welcome.;)
And yes you are entitled to request for a copy of the phone calls.
Yet for even more information you can request a SAR (Subject access request) where they have 40 days to comply and sent everything possible as requested on the SAR, however, there is a £10 charge payable in either postal order or cheque payment, post by recorded delivery.
SAR link to template here:

Going back to reclaiming, you possibly still have good reasons to reclaim anyway, there is more than just phone calls recordings, so if this was the first response, write back and tell them you want this reconsidered, and you stand by your reasons, also let them know both you and other half were covered through employment if you needed to make a claim.
In their final response they should give you details of the financial ombudsman service (FOS) if your not satisfied with the final outcome of your complaint.
More info on PPI here:

But do try by requesting for the copy of the calls for ASAP, if they don't supply free of charge then it maybe worth you sending a SAR.
Good luck and post up to keep us posted and for help when required.;)The one and only "Dizzy Di"0 -

Agree with Di, you have a good claim if you already had some cover, you could be looking at ALL your money back.DS1 12/10/04
