    I reckon the default charges they are refusing to refund as 'it's their policy not to refund charges from more than 6 years' may be refunded when the FOS get involved.
    On what basis were you able to retrieve credit card "default" charges at all?

    Any complaint referred to FOS takes approximately 18 months, so don't be counting any pennies just yet.

    Yes maggy50. I remember I had the card before I started a new job in 2002, so most definitely before then!


    I reckon the default charges they are refusing to refund as 'it's their policy not to refund charges from more than 6 years' may be refunded when the FOS get involved. The reason I say this is that I firmly believe the total amount refundable would not be much more than the fee they would have to pay to the FOS, so it may be a gamble on their part or they may just be trying to see if I just give up after scoring 2 out of 3. Not giving up!

  • I've just received a letter from the Royal Bank of Scotland offering me £3K for ppi on two loans I had back in 1998/99. I used the questionnaire and info on this site to complete my claim. I also had copies of the loans (unlike me to keep info that long!) which I sent along with a list of bank charges during that time which I only put in to suggest that adding ppi to a loan would have put me in further financial difficulty so if I had realised it was optional I wouldnt have taken it. RBS were really helpful, I had a letter and text acknowledging receipt plus a call from the PPI department asking if I also wanted to pursue the bank charges? Obviously I said YES! I've been putting this off for months, but it was really easy, has taken approx 6 weeks from start to finish and I'm £3k better off. Thanks to everyone who posts in this forum and the moneysavingexpert team - your info has been really helpful :T

    RBS nearly £6k for 3 loan accounts between 1998 - 2007.

    That adds to my 2 Egg Loan payouts for £2300.

    Just the CPP and Barclaycard, although if I don't get them, I won't be too disappointed as I wasn't banking on either of the others paying out.

    Basically most of my complaints are from the fact that PPI has generally been added without any real discussion or explanations particularly regarding cancelling them etc.

    This was particularly with my last loan, which was agreed after a call from Natwest, saying would I like a top up loan as my loan was coming to an end and basically name your amount and was done within about a 5 minute phone call.

    Still they have had a lot of interest out me in the past and are still making money from my savings, so I don't feel too bad, at taking money from them :)

    Hi Moneyineptitude, I actually looked in to this when I read various forums/threads on this site. I also had a LOT of charges which were in excess of £28 for going overlimit and paying late. A lot of people on here have referred to the OFT findings in 2006 and claimed refunds as such. I'm in no rush for the money and after spending 19 months battling with Halifax on behalf of my partner (eventually won!), I know I shan't be looking at that money in my wallet any time soon!

    Spoke to Lloyd's today, the first person I spoke to told me I had to put my appeal in writing if I was not happy with the response, which is completely different to what I was told 2 weeks ago and when I challenged her on this she put the phone down :mad:

    I phoned back spoke to a different advisor who said my message from 2 weeks ago had been passed back to the team but they just said as it was still the same reason for complaint they would not investigate further.

    I'm getting so frustrated cos all I want them to do is investigate the case properly. If they had spoken to me and come to the decision then fair enough but to write a letter stating that as they have been unable to speak to me they have made a decision based upon the limited information they have, of course they are going to decline it.

    I'm going to put a letter together stating the full details of how I was sold the policy in much more depth than I put in the questionnaire and also stating that at no time have I been called by Lloyd's, (missed call or otherwise). Do you think I am wasting my time doing this or should I do anything else. Will they just reject it again because it is still under the same complaint? The letter I received stated if I was unhappy with the decision I could call or write to them. Obviously I called, it states in the letter I have 28 days to challenge this or the case will be closed I am still within that timescale so assume it's too early to go to FOS

    Since you've already challenged their decision and been rejected again then you can refer your case to FOS. The invitation to challenge is not an invitation to make the same complaint again-you have to bring something new.

    Do remember that your complaint HAS been considered already. Could you really have swayed their decision had you been in when they called? I doubt it.

    If you remain dissatisfied, take your complaint to FOS now. Continuing discourse with the Bank is just lengthening the amount of time you'll have to wait for an eventual FOS decision.

    Typical time for a FOS referral is eighteen months. Do remember they are adjudicating on your original PPI complaint-not an additional complaint that they didn't handle your original complaint properly.

    Well done on your win :T ....please could I ask if they where big or small loans you had back then?.....as I sent my claim in about 2 weeks ago and am wandering which way it's all going to go ...:o

    I reported on my refund from MBNA last month having received money by just sending an email. Well I went onto Barclaycards website, they ask you to fill out a claim form, which I did. I said I could not remember dates of when I had my PPI as I have been with Barclaycard for many years, and also do not have any documentation. A week later I had confirmation of my claim followed today with a letter saying my claim as been upheld, although they keep records for only 6 years, they have estimated what I would have been charged based on my recent statements, added interest on and I will be receiving £2942.50 after tax, result! :rotfl: That is just over £5000.00 on two cards. Sending off the cpp claim now for identity theft protection, fingers crossed!!
  • If you're having difficulty with the form, I advise you to speak directly with HMRC. While their call answering leaves a lot to be desired (you may be on "hold" for some time), their operators are helpful and patient.

    I cannot advise you further, having never filled a tax refund form.
