    You can refer your complaint to the Financial Ombudsman Service (there will have been a leaflet about it in your rejection letter).
    However, you should realise that not every online sale had a pre-populated box and that the Bank will have checked this as part of their investigation into your complaint. If you still dispute this then write to FOS, but note that the process can take in excess of eighteen months and obviously you won't be able to produce evidence of any alleged pre-ticking.

    I don't think it was pre-ticked in 2002, I think it was pre-ticked from 1999 to early 2001.

    What you might find though, is that there were time outs. During the appliucation process you could read all the gumph, but when you returned to fill out the rest of the form, there would be time outs, and you would have to re-apply for the card, which meant you didn't read everything else thoroughly because of the speed of application. If you sent a SAR check your paperwork for this.

    Thanks for your reply. I have not had the EGG card for a number of years. I had the card for approximately 2 years so I can't remember everything clearly. I am going to write back to Canada Square Operations because I don't think they have investigated my complaint at all. I had their response within one week. If need be, I will write to FOS.

    I've read comments on here previously about boxes being pre-ticked up to 2003 but I don't know if that is the case or not. I can't remember what happened during the application process. What information would I receive from a SAR?

    Has anyone else managed to claim successful for an online application for an EGG Credit Card?

    If you had the card for only two years and regularly paid off the balance then it's possible you paid very little or no PPI.

    Writing back to the Bank telling them you don't believe they have investigated your complaint is a futile course of action. All you will receive in reply is an reiteration of the original rejection and an assurance that your complaint has been investigated. This is all time your complaint could already be in the FOS queue.

    The next stage of your complaint is to refer it to the Ombudsman.

    A Subject Access Request would not return any details of how you completed an online application I'm afraid.

    As I said in my original reply, the Bank will have checked whether your application took place during a period when pre-populated boxes were used as part of their "alleged" investigation.

I am also in a secure job. At the time of applying I had been in my post for 17 years and to date I am still in the same post. At the time of applying I was on paid sick leave as my mother had only died suddenly 4 weeks earlier. At the time of applying for the EGG card I was goign through a very traumatic period in my life caused by my mothers' premature death the previous month. What can I do now? I definitely did not willing apply for Payment Protection and I never would do. Your advice would be greatly appreciated. Thank you in advance.


    I had exactly the same letter on Saturday. To add insult to injury it also arrived with the acknowledgement letter that they were looking into my claim both letters dated 10th September 2013. I've contacted the FOS this morning.

    Having read this it appears that they are not investigating just looking at the dates when the agreements were taken out & seding standard letter saying no.

    I don't care how long it takes. It's now a matter of principle :mad:

    Looking at the dates will inform them that they can safely reject in the knowledge that no pre-populated box was in use at the time. Unfortunately, online applications are not deemed mis-sold because you actively chose to have the insurance and no bank staff were present.
    By all means refer your complaint to FOS, but expect nothing and you won't be disappointed.
  • I've just received a letter from Halifax upholding one of my claims (still 8 loans & 6 credit cards being investigated). I've been offered £443.09 (inc £107.84 interest). Having clarified that this doesnt relate to all loans I have signed the letter of acceptance & look forward to cashing my cheque which could have come at a better time. :)

    Actually, it does if you're lucky.
    Some people get screen shots of their application, I have a series of information regarding the online application, not screen shots but just as useful.

    Strange but I also received an acknowledgement letter dated 4 September and reject letter dated 6 September. How could they have investigated my complaint so quickly? I received both letters yesterday when I returned from holiday. It would appear that they are sending out responses very quickly. I will pursue it further, firstly with Canada Square Operations and then with FOS, if required. I am in no hurry. I've already been waiting since April 2012 for the FOS to get back to me about a loan from Halifax.
