    I have just been told by Barclaycard that they have decided to honour my claim for miss sold PPI and are offering £5,356! So I am very pleased, I have already won a claim for £2,300 from Marks and Spencer. I have not used any claims companies, and all it has cost me is the time to fill in the form, post the letter and a few chasing phone calls! :beer::j

    It just goes to shop it's worth trying, I had PPI on my credit cards, which I took out over the phone, and was told it would help my application to take it out, PPI box on application was pre-ticked standard on application form, I had savings, would have got sick pay from employer and was never advised I could take cover elsewhere.

    barclaycard initially rejected my claim, but I wrote to them asking them to reopen the case, after several weeks of chasing them I have finally got a fantastic result, just got to wait for the cheque now! So good luck with your claims and don't give up or use claims companies, If I can do it so can you!:T

    Hello all, I need some help please. I put in a claim to capital one for OH. Now he wasn't sure how he got the cc and thought he'd applied at a stall in a shopping centre, and spoke to someone. He's finally (6 weeks after initial letter using templates on here) got a letter back from them saying they're not honouring it. It turns out he filled out a form and posted and (they say) because he ticked the box for PPI he gets nothing. They've included a copy of the info leaflet and I can't see anything in it saying if you are employed etc you might not need ppi. He was employed at the time and would have got sick pay/redundancy etc. Can he do anything? Cap one are saying they won't entertain anymore letters about that account.

    Capital One never agreed to anything so there is nothing to "honour". What you mean is they have not upheld your complaint.

    If all the evidence available is an application form completed by the complainant which indicates they asked for the policy then that is what they must go on.
    They've included a copy of the info leaflet and I can't see anything in it saying if you are employed etc you might not need ppi.
    That MIGHT be persuasive if it could be concluded that it was unclear, unfair or misleading AND that if it had not been the policy would not have been purchased.

    you do not say how much - or for how long. So there is no way to tell if that would have negated the need for cover.

    That suggests to me that you do not really know what he really would have been entitled to. There is NO contractual entitlement to redundancy payment other than the statutory amount (a maximum of about £800). Some employers might pay more but it is always discretionary and if you lose your job because they have gone bust you will only get the statutory amount.

    The use of the term "etc" also suggests you have some notion that he would various benefits but have no idea what they are - if they even exist at all.

    I recognise that this is rather harsh but these are objections you need to overcome if your complaint is to be upheld.

    Depending on when the account was opened, you may be able to go to the Financial Ombudsman Service - but on the basis of what you have said here I would expect them to find in favour of Capital One.

    Forward your claim onto the Financial Ombusman, you may have to wait a long while for them to decide the outcome, but who knows they may overturn the decision. Good luck.

    Thanks Magpiecottage he didn't know what ppi was when he filled it out (2005) and the leaflet (which I know has now changed) doesn't explain that if you have other insurances there's no point in having ppi.

  • My claim was for PPI on personal loan taken out in 1999 and a Flexiloan account which dates back to 1996. Both were with my current bank First Direct. I got a letter on Friday offering me just over £6,000. The process has taken one month exactly.

    I downloaded the forms from MSE and sent what little documentation I had. First Direct were very good (as always), they acknowledged receipt, someone called a few weeks later to tell me one claim was being upheld and when I would hear back.

    The interest payable at 8% is considerable and nearly as much as the repaid premiums.

    The letter also said that after 1 October repayments will be subject to tax which I hadn't picked up (obviously haven't read my MSE emails carefully enough!). I should get in before that deadline.

    My advice to anyone is don't delay - it's not difficult.
  • I recently complained to Canada Square Operations about an EGG card which I took out in 2002. They confirmed that I had Card Repayment Protection but would not uphold my complaint for the following reasons. Their letter states that I purchased the insurance through the Egg website on XX August 2002

    "The online sales process at that time:

    Did not require you to take repayment protection insurance as a condition of obtaining the credit card;
    Did not provide an advisory service;
    Required you to positively confirm that you wished to purchase this policy during the online application;
    Provided full terms and conditions of the policy and requested you to read them before submitting.

    I believe that the box was pre-ticked and I obviously stupidly did not change it. I did not require the Payment Protection as I work in a job where I receive full pay if off ill. I am also in a secure job. At the time of applying I had been in my post for 17 years and to date I am still in the same post. At the time of applying I was on paid sick leave as my mother had only died suddenly 4 weeks earlier. At the time of applying for the EGG card I was goign through a very traumatic period in my life caused by my mothers' premature death the previous month. What can I do now? I definitely did not willing apply for Payment Protection and I never would do. Your advice would be greatly appreciated. Thank you in advance.
