    They won't give you the credit agreement on accounts that are closed.

    As long as you photocopied the sheet and sent it with the complaint, your complaint should be an easy one to uphold, unless they respond as I said by saying it was sold over the phone at a later date. Being self-employed doesn't necessarily bar you from using PPI.

    But what I wanted to know is should I get hold of the credit agreement as well to see if they added PPI.
    The credit agreement wouldn't show PPI if you subsequently added it as a result of a 'phone call for example. Regardless, if you've paid off this finance the CCA is no longer available to you.
  • I did that. I think it should be easy one to uphold as well. My edginess comes from MBNA's established stalling tactics - it seems that they reject most of them and although many are then upheld on appeal with FOS I didn't want an 18 month wait.
  • I had two Debenhams store cards sometime in the past and still had my statements which showed deductions for PPI. As I am retired they were inappropriate. I sent off the standard letter as recommended by MSE and received a detailed reply and two small cheques within a week! It was only about £40 altogether, but nevertheless I was impressed with the speedy response. I'd encourage anyone to dig out all their old credit and store cards statements to see if they have paid this insurance without knowing. Good idea for a New Year Spring clean!:j

Your complaint should be upheld very quickly, Also ask MBNA for the date your PPI started, If you were self employed then send them evidence HMRC/Accountant (tax returns etc) (if the case is still in progress and you have this evidence send it in. They will then automatically uphold the complaint its a doddle with them, good luck - big windfall coming your way if you have paid 7k in just premiums. If they reject FOS are doing our cases vs MBNA in around 4 months at the moment and we have a 98% uphold rate against them. I have handled 3732 cases I know the process :)

    Really?
    FOS are taking as long as EIGHTEEN MONTHS for everyone else!
  • Not been fortunate myself in claiming even though I know I was missold a PPI on my mortgage. The Independent adviser who sold me the PPI is still trading though the company he worked for at the time is no longer in business nor is the company I paid the policy with for seven years. FSA also informed me they did not regulate until 2005 and my PPI was taken out in 2001.

    My head hurts :eek:
  • I've been reading about PPI claims for sometime now. Thinking about a couple of personal loans I had with HSBC around 5 years ago. Never really done much about it as I didnt have the paperwork anymore.
    One day I decided to call HSBC to ask for details of the agreement numbers so I could write to them and ask for copies of the paperwork.
    The guy on the telephone asked me "are you thinking of making a PPI complaint? I can put you through to the department right now."
    So I did, they sent me a form out within 2 weeks, which I completed and posted back. 6 to 8 weeks later I received a letter with an offer of £5779.00 which includes 8% interest.

    So chuffed as I was expecting so much!

    Defo worth persuing.

    how long did you have your debenhams card for? I've had mine for 15 years.
    if you go to a company called Genworth financial for your debenhans card. they act quickly.

    Hi Amanda, Have you managed to get a sucessfull ppi claim against Debenhams? I had a card from about 1996 til 2008 and have been refused by Santander who are now responsible! they have said to contact the FLA, who also arn't interested!

    Any help would be greatly appreciated as I paid them a considerable amount over years which I was unaware of!
