    Contacted HSBC 8 weeks ago outlining that we had been mi sold PPI for credit card. Didnt need it or sign for it. Sent PPI letter from ML.
    7 weeks and 5 days later letter back, please complete FOS questionnaire to enable us to complete your enquiry fairly.
    The next day from HSBC request denied and this is theie final letter. Not entitled because we had had the credit card for to long and should have realised we had it (25 years apparently, which is news to me), we get paid whilst we are off sick so we dont need it, they say it is extra money for us to spend and we should have read the bookletthat comes with the agreement and had 14 days cooling off period.
    Anyone help please

    I have just received a letter from Marks and Spencer informing me that my claim would not be honored. :wall:
    They indicated, among other things, that my application was self filled in even though i can remember being approached by a store representative who asked if i would be interest in a store card (1986) so while i accept that my form was filled in by me personally there was a representative present there was a tick book on the form which had to be ticked if I DIDN'T want PPI. I didn't tick it as it was implied by the store rep that it should not be ticked. Am I able to to take this claim further? If so do I contact the Ombudsman or do I go with a claims handler?

    I had the same reply from HSBC last, since I have had my cc since 1995. Sent my case to the FOS and have just had it upheld. Had to wait over a year and should get my offer letter within the next 2 weeks. Don't give. :beer:

    Since you filled in the form of your own volition this is regarded as a non-advised sale.
    You'd need positive proof that the store representative was offering advice (not just handing out the leaflet for you to apply for the store card).

    You can hardly complain of an "implication" from the rep that you should not tick the box to refuse PPI; you'd need verifiable proof that they instructed you not to tick the box in order to complain of being mis-sold.

    You have already complained so cannot now approach a claims handler (why would you do this anyway? A CMC would have no way of improving your chance of success!)

    You do have the right to refer your complaint to the Ombudsman, but I fear you'll wait up to eighteen months for FOS to side with Marks and Spencer given the circumstances you describe.
  • Hi weve received a letter from Genworth regarding my other halfs Burtons account, now this has been going on for about 1 and a half years and weve had to really fight it out! Today we have received a letter saying they will be paying out, but after looking neither of us can get our heads around the figures! They just dont appear to be right, could somebody please help?!
    The ppi policy start date was 17/10/97 and ran until 17/10/03.
    It says premiums paid £325.77
    Simple interest at 8% £248.07
    Total redress due:£573.84
    Luckily we have most of the statements but there are some missing, but you can clearly see that on some that from one statement to the other the balance has continued to grow, therefore the ppi would be applicable on those missing statements too which it doesnt look like they have calculated. Please could someone take a look at the figures and tell us if theyre right or wrong, would be very grateful :)

    Thankyou, we sent an email monday night, faxed paperwork again tuesday morning , had a phonecall today.
    lloyds are paying out this ppi and three others.

    We've had two letters (finally), one from Argos and one from Capital One. Both rejecting our complaint.

    Argos go into detail in the letter of a phone conversation between my partner and them re:PPI. He doesn't recall it, however that doesn't mean it didn't happen.

    Having said that, is there any way we can ask for evidence of this call/recording? Are they obliged to share it or do we just have to take their word for it?!?!??!

    Any advice appreciated. Thanks

    If this is the case (very likely since the period in question is 16 years ago), then you'll only be refunded what you have proven you paid. If you don't have these "missing" statements, then it's a little optimistic to expect Genworth will either!
    Thats fine, were just not sure if the amount they have quoted is right or wrong :)
