I've just had a very pleasant phone call with a lady from Lloyds.

A few pages ago if anyone remembers, I emailed the CEO and got a reply back saying that they were going to review my complaint again. I had emailed and sent a in letter detailing new evidence to my earlier rejection. This was that I had a pre existing medical condition and PPI would not have paid out. I had only got details from my Dr with the dates and the reason I did not put it in my original questionnaire is because I had thought I was diagnosed after I had got my credit card but it was 5 months before.

Anyway, to cut a long story short the lady that emailed me late last week rang today and said they had reviewed it and my credit card complaint has been upheld! I took applied for this card in 1990!

So to those who say that there is no point in sending in further evidence there is, IF you have further evidence to show that there was a mis sell and if you go to the top, it speeds up the process! I hope this gives some of you a bit of hope.

Its gone to the calculation department and she said she would ring me possibly Thursday with the figure and send letter with the calculation later this week.

Things like this don't happen to me! :j

Do you have the CEO email address? Thanks

They were unable to uphold your claim but have made you an offer!!!
What a farce, how much was the original PPI?, if you know this we can get an idea of the redress and if it is correct, what was the "insufficient evidence" ?

Hi Amersall, the letter doesn't say how much the PPI was. The insufficient evidence was I think that they don't think I was sold it unknowingly or unfairly.
But my main complaint was that I booked an appointment in my branch to cancel the PPI and when I went there was a panel of 4 people to talk me out of it. The branch manager asked me if my parents were wealthy because if I died my debt passed to them to pay off.
I went through all the details with the PPi man and he asked loads of questions but its not even mentioned in the report as part of my complaint let alone any findings he has made.

Is that worth persuing do you think?

    Thanks

I have never suggested there is no point in sending further evidence, I've said that the new evidence has to be significant and also verifiable.
    Your evidence was both.
I'd have to ask, though, why you didn't include it in your original complaint?
  • Hi , after reading all these posts for ages . think its about time i did something myself . I had a phone call last week off a company telling me id had mortgage PPI thats was taken out in 2005 and ran until 2010 .. It was a one off payment added to a remortage done in 2005 , It was done via another company not the mortage lender . The woman on the phone told me id be able to claim all of it back .. I hunted through the Cupbaord and found a letter dating back to when it was advised it was about to expire so i have the policy number on the letter .. What do you think my chances are of getting it back ?

Also feel like im banging my head against a wall with Santander , The last loan we had with them joint was back in 2006 . I singed up with Noddle last night and it gave me details of that Loan which was considerably higher than i remember taking out & can't remember if it had PPI or not . If all prevoius loans came out of the same bank account can they not trace them all back with an account number rather than a loan number ?

I think thats all for now , if anything else comes to me ill post again

Since this is not strictly a mis-selling complaint (you'd already bought the policy) I doubt you'll get anywhere by attempting to take this further.
Well done on having received an offer of some redress...

Reasons for not upholding my complaint was: I said I had to take the ppi other wise I wouldn't get my mortgage, this was in 1997 my mortgage started. The bank said the ppi was optional. After searching everywhere I found my paperwork and on this paperwork it said: I had to take Lloyds Tsb mortgagesure as a condition of my mortgage.
That's providing verifiable documentary evidence. (Well done, by the way;)) By comparison, attempting to argue a hearsay complaint by demanding the Bank send their own evidence is completely futile.
  • So glad to hear of a success with Egg Credit Card - please could you tell me what year you took out the Credit Card, because both my husband and I applied for a credit card at the same time, and neither of us requested PPI, and he has been successful with his complaint and received back the PPI paid but I haven't - and we both believe that it was a pre-ticked box on the internet. Any help would be great thanks.

We took out both of these credit cards in 2006, and it was a pre-ticked box. I have sent off the claim for my card now too so fingers crossed I get the same result as my husband, good luck to you too!

Yes they can. If you owe them money, they have the right to use any refund against an outstanding balance.
They shouldn't have paid it straight to you in the first instance.

Although, I may not have understood completely.

When you received the 700, was that in the form of a cheque, and where did you put it? If it was in a Barclays account, and the money put you in credit, they can use it against the Barclaycard.
They can't charge you another 700 and add that to your barclaycard because that's bsically saying that they were wrong to refund you, and they have reclaimed their original 700.
