    Thanks for coming back to me! Loans were all rolled over if that makes sense but finally paid off in 1999. Three in total all with ppi but probably only for about £7k (? Guessing) Cosent to cover is as I said before, a seperate signature on a seperate part of loan agreement. Weren't covered by fsa then but by ABI which 'expected its members to conduct business with utmost good faith and integrity'

    Hi all,

    I took a loan out with The Bank of Scotland(via sainsburys bank) back in 2003 which included ppi.

    I recently submitted a claim via sainsbury ppi claim line, on the basis that when I took out the loan i was told basically that I have to take out ppi or I would not get the loan.

    I have now received a letter from bank of Scotland rejecting my claim on the basis that I was made aware of the optional nature of the policy (as it has never been a requirement to take out a ppi policy and this would not have made any difference to my loan application at the time). Also apparently my credit agreement clearly demonstrated that the ppi was option despite the fact that I was under pressure to sign this by a waiting courier one evening.

    In addition the letter also states that as the sale was made on a non contact basis they were only required to provide info designed to ensure that I could make an informed decision as to whether the policy met my personal requirements.

    I am not sure what they mean by non contact basis as although I initially applied for the loan on line I am sure that I received a follow up call from sainsbury to approve the loan.

    The letter has provided a contact number to call if I do not agree with the decision and if I can provide any further evidence to support my claim, not sure what additional evidence I can provide. Can anyone please advise whether to accept their decision, go back to the bank or go straight to the ombudsman?

    Any advise re the above would've useful.

    Mine is asking for additional information if I want to contest too but I have nothing?! What sort of thing do they need? x

    Well my dad had a nice surprise today.

    He filled in a form a few weeks/months back to see if he was entitled to anything back.
    He had an offer of just over £6,200 today.

    hi there again its a game to them i think its called CALL MY BLUFF like i said before get them to prove this signature.i think they will fail but i you have to try.call them on monday and wait.good luck

    If you’re reading this and thinking that it won’t work for you, just DO IT!!! I didn’t even have to fill in the questionnaire for the fourfold reference, all it took was a phone call, now paid for in spades. :j

    Ah, I obviously got a bit overexcited. The payment I received was in fact for loan #1, for which I lacked the details and had to fill out the questionnaire for. So that leaves me with the four bunched claims, at 9 weeks and 3 days without hearing a thing... Maybe I should start badgering. Or not.

    advice is difficult to give i read this site every day and being a cynical old git i think that the banks top brass have said enough is enough start slowing payments down. its costing to much.
    so that means they are going to use every dirty tactic dodgy reasons they can think of not to pay. SORRY TO BE NEGATIVE but thats how i see it

    I had the same Sainsburys rejection letter last week. :(And signed for under the same conditions i.e.courier at door.It appears to be a bog standard letter, delay tactic.

    I have written back and have reiterated my complaint, saying that I dont agree with their decision. I have given them 14 days to respond, and requested that they revisit their decision or I will have no choice but to take it to the FOS.

    Every other financial institution have upheld my complaint, and reasons were the same. So why would their policies be that much different from other institutions.

    Keep fighting, show them you will not give in. Out of curiousity it would be interesting to know if there have been any successes from Sainsbury's as I to date have not read of any.

    My partner has just received a rejection from Halifax. Applied for in 2003 so pre FOS. I have just drafted a letter for him quoting one of the GISC Code provisions if it useful to anyone:

    If it is practical, we ( the financial institution) will identify your needs by getting relevant information from you.

    I also wrote that : he was entitled to place his trust in the professional advice given to ensure that reasonable care in ensuring the policy was in fact suitable for his needs.

    Sometimes knowing what to write back can be frustrating so if it helps anyone :)
  • I just received an offer letter from RBS for 3 loans I took out in 2002 and paid off in 2005.

    The offer was for nearly 6000GBP, which according to my calculations is actually a lot more than the total PPI payments I had made on the loan, including any interest.

    I'm a bit worried that if I accept the offer and the realize they have made a mistake, could they ask for some of the money back?

    Thanks to MSE website for all the useful advice, I wasn't going to bother claiming because I didn't think they would give me much and thought the loans were too old, but it all worked out very well for me.
