My ex's credit card. Opened in 1998, was told he had to take PPI. Never needed it, company benefits, life assurance, BUPA, personal pension, etc. Paid off his balance about a year ago when his pension paid him a lump sum. Cancelled about 18 months ago when he heard through a friend did not have to have it. Was paying up to £150 a month just for the insurance. He had no idea he could reclaim until I approached him recently asking him if he still had any old paperwork of mine.

My ex got a rejection letter from MBNA yesterday, saying it was a non advised sale, which is untrue. When he received the postal application, never having had a credit card before, he rang to ask some questions. In particular, he asked why household income, as well as his personal income, was being asked for, as he was not applying for a second card on the account for me. I actually earned more than him at the time and the advisor told him he should put joint income down as it should help his credit limit.

But the same advisor told him he had to tick for PPI as he would be turned down for the card otherwise. She did not ask for any details of his personal circumstances in relation to benefits, nor explain the financial implications of taking the PPI.

I really think he should put his response in his own words and ask them to reconsider before he goes off to FOS, but would be grateful for some input on his situation before I advise him further.

Many thanks to all of you who have helped so far, look forward to posting a success story of mine or his very soon, x
  • Hi folks, just a quick thank you, my son used your ppi template forms and got £1600 back, wouldn't have had a clue what to do myself so thanks again
  • To all those waiting on a decision from Lloyds TSB. My 8 week deadline was up at the end of June but they wrote to me on 22 June to say they had not completed their enquiries and needed another 8 weeks. I have since chased and they say no decision still and I will probably have to wait the full 16 weeks. No point going to Ombudsman as they will take a lot longer so trying to wait patiently!
  • Everyone I would just like to say a big thank you to this website for giving me the gumption to go it alone for reclaiming PPI. To date the total amount sucessfully reclaimed is £14,428.11

This is the breakdown so far:

MBNA - ( A/L credit card finished in 2003) - £4014.91 goodwill payout no quibbles claim also passed on to Santander for their proportion TBC no response as yet!
Halifax -(mortgage taken out in 1994!!) - £5153.12 again no quibbles
Halifax -(credit card from 1994!) - £1130.02 goodwill payment
Egg Loan - (taken out 2003) - claim upheld no quibbles £4130.06

Egg credit card cant find account number and think Barclay card are now responsible so will need to try and track down the info. So pleased I did it myself have paid off some of my debts..Yay!!

I am just wondering whether anybody has had any luck with Sainsbury's. I took a loan and credit card out with them back in 2003. When hit with financial difficulties in 2009, I tried to make a claim and they said I wasnt eligible as I was self-employed. I made a call today to check on progression. And I was informed that the claim had been rejected for the Credit card but they were still making a decision on the loan. Letter of explanation to follow. I have every intention of following this up, first rejecting their rejection and then if required on to the FOS. I applied over the phone and then cheque was delivered to the door. I was to sign, but not ask questions as the courier wasnt a financial advisor.

Just curious as to any successes against them. And how best to address the rejection letter.

    Update on other claims :
    MBNA: Upheld £4061
MBNA: Upheld £623 (payout was more than my balance ever was - which was paid off last year)
    Halifax:Upheld £2777
    Barclays: Still waiting outcome
    Asda: Still waiting outcome
    Sainsbury's CC: Rejected
    Sainsbury's Loan: Still waiting outcome
An old Adams card dating back to 1991 ( still had some of the old paperwork and was still on my credit file even though it was paid off in 2003) : Still awaiting outcome.

Barclays very helpful, I phoned them up today to check progress and they told me I had 4 other PPI policies. 2 from current overdraft facilities ( One of which I recently tried to claim on and they are giving me the run around!!). The other 2 apparently predate my existing policies, one of which I think is joint cover from late husband. He gave me an address to write to in Ireland to request copies of all policies. As they only go back to 2001/2002. I happily informed him that I had all my bank statements from 1999 ( previous statements had been destroyed in a fire). He started up proceedings for me to claim them back. Fingers crossed.

Again I cant reiterate enough DO NOT use a CMC - I have done these all myself using MSE templates. And am now helping my mum and MIL to claim theirs back too. Cant thank everyone enough on these forums for all the advice they give ( even if indirectly) it has been an excellent source of knowledge. Thanks needs to go to all the Posters as without them the whole process could be a little daunting :T

thank you for bringing this to our attention , you are right, people need their money now,and lloyds playing a game with people taking an extra 2 months , and fos would be 2 years , people cant afford to do that, what choice to people have nothing, so thats why the banks do it, their behavior shows me despite everything they still treat the customer with contempt at any opportunity

Alliance and Leicester Loan upheld - £800, upheld and paid out within 1 month of complaint (was phone sold so I expected this to be quick)
    Lloyds Loan
Lloyds credit card - both rejected, mainly on the fact that we could afford the insurance therefore it was fairly sold, despite only recently finding out that PPI was on the CC!

Have complained to the FOS, how long did others wait for a result from them? their info says up to a year, but I wondered what was typical,

not exactly an example of the banks playing fair, very disappointing , thank you for bringing this to our attention

Well I sent my acceptance letter to Barclays on 5th July but hadn't heard or received anything so phoned them yesterday. They claim they haven't received it, and had sent me a chaser letter which came this morning.

What's the best practice now? Ask for another letter and send it back recorded delivery?

unfortunately its a dirty tactic used, to slow down payment out and in some cases no payment will ever get made, sad but true , its a shame martin didnt get into things like this with the banks when they were discussing speeding up the process
