PPI Reclaiming successes and failures

I recently wrote to Barclays asking for a copy of a Barclayloan agreement, I didn't have any paperwork left other than the last letter which happened to have the old account number so I included that to help as much as I could. I used the Word template from this site (thanks btw!!)
What I got back was possibly the rudest letter I've ever had from any large organisation. Given how much bad publicity the PPI issue has given them on top of the recession vs bonuses and now the rate fixing, you'd have thought they'd have been a bit more careful about how they deal with potential claims and annoyed customers, but no.
The longest part of the response I had, asking for a copy of my agreement was this -
"Our systems show that there is no sum payable under the credit agreement and therefore there is no requirement for us to comply with your request."
So not even "Oh it'll cost you a tenner" or even a request for more info about why I want a copy of my agreement - just a curt refusal to even consider sending me a copy of my own financial agreement.
It's not often letters from banks, councils or large firms leave me speechless, but this took my breath away it was so dismissive!0 -
I reclaimed PPI from an Amazon credit card
The provider was/is HBOS
I received £343.00
I followed the 2 steps provided on this website - letter requesting info and then filled in the form and sent that. I received the cheque after 6 weeks.
I reclaimed as I took out the PPI because
1. I felt that I had to have it to get the credit card;
2. it wasn't explained to me that if I had any previous medical conditions I probably wouldn't be covered if I needed to claim and
3. I I had permanent health insurance with my job ...
Happy, happy day :j Thanks MSE :T0 -
new to this, but thought i would share my success. I presently have 4 claims in - MBNA cc, Capital One CC, GE Money store card and Mastercard CC. I found some old CC statements whilst have a clear out never really realised there was PPI on them, so thought that i would give it ago. Sent questionnaire off and copy of statements to MBNA and Capital One on 8 June. MBNA acknowledged this within 5 days, Cap One, not quite as quick. I was really shocked yesterday to get a decision upholding my complaint from MBNA which was less than 4 weeks. GE Money was only sent last week, but acknowledged yesterday. On with the MAstercard now which in fairness i wasnt going to claim against. This account is still active whereas the others aren't, but i rang to cancel the policy as it clearly states on my statement as optional payment protection, thought no more of it but they have written me with a questionnaire to complete, do they know something I don't and should I pursue it?
Am still in shock at MBNA upholding so quickly, have a feeling from posts on here Capital One will end up at Ombudsmen, but if thats what it takes!
And a big fat raspberry to claims companies, cost me £1.85 per questionnaire (recorded delivery) and a bit of time, you dont need them, just a bit of research it can be done0 -
Sweetpea.
Can i ask about your GE money claim?. I have a burton card that was run by GE money and they sold me the ppi but it is now run by santander, do i claim to santander or try GE Money first?
Good luck with all your claims!0 -

I sent it to GE Money, they have acknowledged it and said they will have a response by 28 August. They haven't advised me to send it to Santander although I was going to initially.0 -
Does anybody know the address to write to Marks & Spencer?
I'm helping my mum reclaim and she had a loan with them back in 1999.
Thanks0 -

You will have been sent a standardised form reply, so I wouldn't be so sensitive to the "rudeness" of it. It's a case of, as Joe Friday might have said; "Just the facts, Ma'am, just the facts":)
If you pay £10, you still won't get a copy of the agreement. What you'll get is a Subject Access Request (SAR) report with details of information the Bank holds on you for at least the last six years and (sometimes) more. They have 40 days to comply. There is an excellent template here:
https://forums.moneysavingexpert.com/discussion/1475553
...but do read carefully before use, as you don't want any more "rude" surprises from Barclay's;)
By the way, if you already know the account number of this loan and have valid complaint reasons, then you can skip straight to complaint without going through this SAR process at all.

As before, do read carefully before proceeding!0 -
Hi can anyone help I wrote to Santander re a car loan taken out
in 2002 they have come back to me replying that the
Car dealer who I bought the car through are responsible
for the ppi and I should take the matter of missellimg with them
Surely as I took the loan out with First National
now Santander they are responsible for the ppi and misselling
I have the loan agreement and insurance
Can anyone help? The loan was between myself and
First National (Santander) not
The car dealer!0 -

Write back and reject the reasons they have for not upholding, let them know that this Single Premium PPI on all loans was mis sold, at the point of sale it was not explained to you the full cost or the unfair rebates that would have been applied to these loans and you do not want the rebate amounts refunded you want the whole PPI back for each loan as they were mis sold, ask them to reconsider this decision or you will pass this claim to FOS who uphold the majority of these Single Premium PPI.
Thanks for your response, I would appreciate anyones insights to the response I have drafted this evening. In perticular is my request of a response in 14 days fair?
=========================
[FONT="]Thank you for your letter dated 29th June 2012
I would like to reject the reasons you have supplied me for not upholding the claims of PPI on the above referenced loans.
The Single Premium PPI were mis-sold, at the point of sale it was not explained to me the full cost or the unfair rebates that would have been applied to these loans.
Additionally to your proposed refund of the rebate amounts, I also require the whole PPI back for each loan as they were mis sold.
Please reconsider your decision or I will have no option but to pass this claim to the FOS who uphold the majority of these Single Premium PPI.
I would like your response within the next 14 days.
