    Capital One really have no idea what they're doing, do they? About a month ago I got a final refusal from them, by letter, which I then passed onto the FoS. That was that, I thought, won't be hearing any more about that for several months at least. This morning I got another letter from Capital One, apologising that they have not been able to resolve my complaint and letting me know that they'll get back to me within 4 weeks.

    I'm looking forward to what they decide, obviously. But it did raise in my mind the question of whether the first letter, the refusal, was in fact just a delaying ploy. Or could it be that Capital One are just useless? Has anyone else had this experience?
    It is possible that the FOS has contacted them, it is also possible ( most likely :D ) they are fobbing off.

    I am reluctant to give up as I have been off ill for more than 2 years now and given the status there is a strong chance of me loosing my sight, unlikely I will return to work.

    If I had thought I had insurance, I would have claimed before now.
    This may be a hard one to win, why pass this to a claims co when you have done the hard work already?.

    Write back in your own handwriting ! the rejection and pick out the points that you need to highlight on the rejection letter they sent you and make a copy to send in with a copy of your agreement.
    Its not my handwriting and more interesting is, I'm a lefty, I also tick to the left. The insurance tick was clearly ticked by the person that filled in but that was not me. It is however signed by me.
    It is the sig that is the most important, the sales person would have filled this in for quickness, this does not mean that you accepted this PPI simply that the box was ticked.
    In the Payment Protection section of theapplication form, you have ticked the box to select PPI, written your name,written your date of birth as the insured person, and ticked to say that theinsured person is the main applicant. Therefore, it would appear that you read and understood the PPI sectionof the application and desired the policy to be applied. This also demonstrates that PPI was optional.
    They have assumed you knew all about this PPI when you clearly did not, this disproves what they have put, send a copy of the agreement back to them and highlight the quote above to show that you clearly did not fill this form in and that it was done for you.
    ·Details regarding the PPI and the account termsand conditions were attached to the application form, especially at ‘Fordetails see condition 7 of the ‘Terms and Conditions’ section and Additionalinformation, as directed on the application form itself.

    Further details were sent to you that showed thefull costs, terms and conditions, benefits, exclusions, and situations underwhich a claim could be made. You couldhave queried these at anytime.
    They cannot use the above as a reason for rejecting the complaint, this is according to FOS, so put this.
    ·You could not claim for problems arising out ofany pre-exsisting medical conditions, as fully explained on application and infollow up literature. You should havenot taken the insurance.
    Ask them who explained this to you.
    If I had thought I had insurance, I would have claimed before now.
    Use this too.
    This may not work but give it a shot, you have nothing to lose.

    If all of the above does not work, then tell them, as you were not mis sold this PPI you want to make a claim on the PPI, back dated with interest as you were not aware you had this and did not make the claim at the start of your illness due to this fact and also because you had the PPI FULLY EXPLAINED TO YOU AT THE POINT OF SALE :rotfl::cool: see what they come back with.
  • Claimed back PPI from 2 loans taken out with Black horse finance
    Used a claim form downloaded from their website which is the pink and white standard complaints form. Telephoned prior and they happily gave me both reference numbers and confirmed that yes i had paid PPI.
    I then completed 2 forms for the 2 loans, same reason we were told the PPI was compulsory at the point of sale for both (and that we wouldn't get a loan anywhere without it!)
    2 different responses
    1/ We do not agree that you were missold your policy as we believe you were eligible to claim if you needed to. Response- Actually you told us it was compulsory! So we disagree- they are now looking into it again..

    2/ Sorry for mis selling you PPI on your loan, offered full refund plus interest would have accumulated on the amount since, total offer £1187. Just one letter acheived this so they must say yes and no on a 50/50 basis!
    Needless to say we will be holding out on the other policy even though it is probably only about £200, its the principle now.
    So fill in the form send it off, you have nothing to lose!

    Hiya,
    Hoping to get some advice as to whether i'm wasting my time. My boyfriend was given a credit card by hsbc when he was a wee lad starting uni, and thought it looked good in his wallet, so he just kept it, and racked up over £5,000 paying rent and the like. This was in 2002 I think. He still only pays the minimum every month (I've tried to get him to pay more, but he's useless with money) anyway, because he barely read the ts and cs I sent the sample letter to his bank requesting all the details of his credit card agreement to be sent to him. That was beginning of May. I heard nothing, and the cheque I sent for £1 to cover admin fees has not been cashed. I just printed out another letter requesting the ts and cs.

    Am I wasting my time? Has anyone else sucessfully reclaimed from a credit card?

    If he gets money back, he'd better take me out to dinner or something! :D

    As this card is still running, you only need the card number and reasons for mis sell to make a claim.

    If he was a student and did not work when he got the card then he was mis sold on the unemployment part of the card, use this as a reason and look here for other reasons that may apply.

    hi i have a LTSB current account and a few years ago(not sure when) i was in finacial difficulty so blackhorse had offered me a loan to pay back the bank what i owed. They took out a certain amount every month, but i cant remeber how much and i checked my bank statements and cant see any of this? Now where on earth do i start to make a claim and with what information. so so sorry to ask, but im thinking i may as well look into this. Also i have had a few catalogues. Do i just write to them? Help :) any help please inbox me if i dont see this xx:(

    Rang central capital for an update this morning on my ppi miss selling claim and was told it had been fully upheld :beer:

    Not sure how much I'm getting back yet but told I should have an offer letter within the next two weeks. I have been grinning like a Cheshire cat all day!!!

    Further to my previous post about Barclays sending me a scruffy handwritten cheque for £243,32, with no breakdown in the letter, I phoned them today, and discovered that they had inadvertently forgotten to send it! In fact the PPI total payout was £1462.22and the cheque was for the 8%. The rest was offset against my current balance.

    Very chuffed! Thanks to the advice given on this forum, my debtfree date has reduced by 10 months in the space of 5 days!

    Replies still awaited for 2 more claims (not holding out much hope on those as they are credit cards).
