    Hi madcat.

    Yes, my original complaint against FD took about 6 weeks from start to finish, and then another 2 weeks to pay into my account.

  • Ah, thanks Amersall. I thought this thread was just for PPI Reclaiming successes and failures!

    In which case it may also help you to know that my card protection was with this very organisation. But they didn't (mis)sell it to me. That was the responsibility of my bank, First Direct, so that's who I complained to.

    the day has just got even better, we have just found out that Halifax are also redressing £3364 for mis sold ASU premiums !! cant believe this has happened to us both on the same day !!

    I posted a knock back letter I received from Marks & Spencer on Saturday. below

    I'm posting it again because firstly, I received another letter today saying pretty much the same thing but this time they enclosed a copy of my application which they say I filled in. As I thought or vaguely remember I clearly didn't. Its not my handwriting and more interesting is, I'm a lefty, I also tick to the left. The insurance tick was clearly ticked by the person that filled in but that was not me. It is however signed by me.

    What should I do?

    The sale of this Insurance is deemed to be ‘non-advised’,so no advice could have been given to you regarding the merits of the policy.

    ITS TRUE I FILLED IN A FORM FOR MY CHARGECARD INSTORE BUT I WAS APPROACHED BY MEMBER OF STAFF AND ASKED IF I WANTED THECARD. I CLEARLY DON’T REMEMBER TOO MUCHAS IT 13 YEARS AGO.



    ·As you completed the application in an M&Sstore no M&S money representatives were present so no advice could havebeen given to you by our staff about the merits of this policy.

    ·The full cost of the insurance was outlined onthe application from. ‘The premium rate is 66p per £100 of the outstandingbalance’ which you could have queried before signing

    ·In the Payment Protection section of theapplication form, you have ticked the box to select PPI, written your name,written your date of birth as the insured person, and ticked to say that theinsured person is the main applicant. Therefore, it would appear that you read and understood the PPI sectionof the application and desired the policy to be applied. This also demonstrates that PPI was optional.

    ·Were you have signed the Payment Protection itstates ‘We strongly recommend you take cover by ticking the box’. This shows PPI was optional.

    ·Details regarding the PPI and the account termsand conditions were attached to the application form, especially at ‘Fordetails see condition 7 of the ‘Terms and Conditions’ section and Additionalinformation, as directed on the application form itself.

    ·Further details were sent to you that showed thefull costs, terms and conditions, benefits, exclusions, and situations underwhich a claim could be made. You couldhave queried these at anytime.

    ·Policy documents were issued to you detailingthe benefits exclusions and cancellation rights. These should have been consulted by you toensure the cover was suitable.

    ·By signing the overall credit agreement, youconfirmed you were happy with the content of the application form including PPIterms and conditions.

    ·The policy has been charged on a monthly basisfor 13 years and clearly detailed on your monthly statements. You could have contacted us at any time toquery or cancel the policy.

    ·None of our literature have ever suggested thatour customers applications for credit would be affected in any manner by takingPPI.

    ·We sent you updated policy documents on aregular basis and also wrote to you during September 2003 to inform you that wewere transferring your Chargecard account to a Credit Card Account. This letter confirmed that any existing PPIwould be transferred to the Credit Card account.

    YES, AND I WENT INSTORE AND COMPLAINED SAYING I DIDN’TWANT ANOTHER CREDIT ACCOUNT AND THEY TOLD ME I HAD NO CHOICE AND FROM THE STORETHEY CALLED THEIR HEAD OFFICE AND I SPOKE TO SOMEONE ON THE PHONE THAT TOLD METHE SAME THING.



    ·We again wrote you in 2007 to make you aware ofsome of the changes to your PPI policy. You did not contact us at this time to question or cancel the policy.

    ·You could not claim for problems arising out ofany pre-exsisting medical conditions, as fully explained on application and infollow up literature. You should havenot taken the insurance.

    I am reluctant to give up as I have been off ill for more than 2 years now and given the status there is a strong chance of me loosing my sight, unlikely I will return to work.

    If I had thought I had insurance, I would have claimed before now.

    I was thinking of maybe passing it on to a claim company?

  • After reading MSE about recovering PPI sent off the letters as suggested, completed the questionnaire. Last week heard back from Natwest confirming that as a "goodwill" gesture and that they were not admitting any liability(!!) I would get back over £1400 in mis-sold PPI. The next day a letter from MBNA (Virgin) confirming they would be sending a cheque for £1,919.99 in refund of PPI.

    Cheque from MBNA has now been received!

    Initial letters went out at the end of February so it did take some time and chasing, but you can get that £ back!
  • Could someone please help with this query. I have sent in 2 PPI claims one from 2005 and one from 2001, If they get rejected can I go to the financial ombudsmen due to the age of them ?

    Please don't use a claims company. Stay on here I'm sure amersall or moneyineptitude will be along in a bit with some advice.

    Loan taken out around 2002 with Natwest. Refinanced a number of times and paid off in 2008, after redundancy, I then closed my account with NatWest
    I was told that I had to take PPI or I wouldn't get the loan. My job paid 6 months on full pay and 6 months half pay sickness benefit, so PPI was unnecessary.
    The PPI was front loaded.

    I didn't think I qualified for refund as I had claimed on the PPI a couple of times. I discovered on here, that, that was irrelevant.
    All I had was my old bank account number and ONE loan reference number.
    I completed the template letter from here and NatWest received it on 2nd May. 3 weeks later I got an acknowledgement.

    Today, I have had offers totalling £10,751. This includes interest and tax paid.
