PPI Reclaiming successes and failures

Quick update
This morning's post contained a nice surprise, MBNA coughed up £2k within three days of their settlement notification letter.
I am still in a pleasant state of shock:eek: as the whole thing from complaint to payout has been completed within one calendar month.
Thanks again to MSE for motivation provided.:A
I don't consider myself a lucky person, I don't win much ever, but this has certainly lifted the spirits during some tough times. So my advice FWIW folk is just go for it, it is your money they are holding.0 -
Hi Amersall, I would appreciate your advice once again, regarding this letter from Redcats....please:)
I got a reply from Redcats this morning -
" We have checked our records and have confirmed that there was a PPI product in place in respect of the above credit account. The credit account was opened on 25th September 1998 with PPI sold at a later date and added to the account on 5th January 2006 (PPI was not sold with the credit account as a condition of opening the credit account or otherwise). Also (and for clarity), the PPI product in question is not a "single premium" PPI policy but charged by reference to the monthly credit account balance (premium shown as a separate line on account statements provided where there was an outstanding balance on the account and was fully optional).
At the time of sale, customers were sent an information pack in the post including policy terms and conditions and details of what was and was not covered under the policy with details of the customer's right to cancel the policy.
The claim which you have submitted has been made more than six (6) years after the event complained of (sale of the Product - see dates above) and more than three (3) years from the date on which you became aware, or ought reasonably to become aware, that you had cause for complaint. Not only has the policy been clearly referred to on every account statement, but following an investigation by the FSA back in 2006, we wrote to certain policy holders (including you) in 2006 to ensure that you were satisfied with the product and that it provided the required cover. Our view is that your claim is time barred and is outside the jurisdiction of the Financial Ombudsman Service. (FOS).
If you are not satisfied with our review of your complaint you may refer this matter to the FOS at the address below (even though our view is that, as stated above, the claim is outside of FOS jurisdiction)......"
MY QUESTIONS
Am I outside the FOS jurisdiction if the PPI was added to my account in 2006? (As Empire became Kay & Co in 2008, this part of my claim is now with the FOS). IF I do not have a valid claim with Redcats, where does this leave the other part of my claim with Kay & Co from 2008?
Also, when they wrote to "certain policy holders (including me)", regarding my "satisfaction with the product" in 2006 - I can't have had the PPI very long, as it was only added to my account in 2006. Certainly, I would not have been aware that this policy was unsuitable for me, having just recently been sold it, under the recommendation of the Sales Advisor, in January 2006. I had no reason to question my suitability to this Policy at the time of sale. I did not request this Policy. I was advised to take it out, by the Sales Advisor, and at no point in the telephone conversation did the Advisor ask about my employment status.
What you think?? Any point in taking this part of the claim to the FOS?? I have already sent a copy of my initial Redcats complaint letter, along with the Kay&Co (2008) part of this complaint, to the FOS, explaining that I was awaiting Redcats reply. Do I now forward the Redcats rejection letter to FOS??
Thanks for your help with this

I'm over the moon:D:D:D
Their reason for upheld given, was that they were single premium PPI policies.

All my working life I have been continually paying off credit cards and loans, armed with information from this site, I have just received £8400 from HFC and a whopping £27,500 from MBNA, and I am still awaiting the outcome of 4 more claims still in progress, I am now completely debt free for the first time in my life. It was so easy to claim and completely hassle free. Thanks to all at MoneySaving Expert.com for the great advice and template letters.0

After yesterday's nice letter from mbna, Egg have written today to say they also uphold my complaint for "card repayment protection" and owe me the grand sum of... £11.50 lol
Now I know the card only had a limit of £750 and was maxed out then paid off in a few years but why would a company bother mis-selling if they were only making £5 (the apparent ppi cost)?
Not as nice as mbna's 3 figure cheque. But I guess every penny counts? We must become the change we want to see(Gandhi)0 -
