Hi there, what a nightmare !!!.
Getting an unenforceable debt is very complicated, if you can get it done, it seems you have paid out and will continue to pay out to this company, they have made a mess of it to say the very least, how was the debt deemed to be unenforceable?.

You are better posting your question here

They have more experience regarding this and can help you more.
I hope you can do something regarding this.

Thanks for the link. Latest news is that I do indeed have to keep paying as the court fees due means that unless paid, the case is thrown out and I am liable for a lot more payments regardless. Rock and a hard place it seems! I will try and get some more advice on the mentioned forum. Thanks again.

Following on from my ppi success yesterday I am going through files of old paperwork because I'm sure I had another loan with MBNA. I am now a little confused and would appreciate some advice. I have actually found the loan agreement form on the loan that I had a refund yesterday and that states that:-
    Cash advance £20000
    Total charge for credit £4652
    Insurance advance £3759.46
Total charge for credit for insurance loan £874.34
    Total amount you pay £29286.60
I must have been so naive or probably desperate at the time to accept these terms but now I'm older and a little bit wiser and am wondering why I have only been offered £765.06!!!
I was excited yesterday but a little deflated today - could anybody please advice.
    Thank you

You get PPI back that you paid, if this loan was settled early this will affect the PPI refund.

Got the letter today in the post offering me £2200... have sent the acceptance form back .. no hesitation! Shame its getting paid to my credit card like but i can still spend it none the less!:D

Sometimes they pay the redress back to the card and then raise a cheque for that amount to send to you, find out if that is what they are doing.

Hi everyone, I sent off a questionnaire to Barclays a week ago on my husbands behalf. He had a loan in the late 90s then kept topping it up each year, he was told he wouldn't be accepted without the PPI, we have no details only his old Barclays current account number. Anyway thought I'd give it a bash and just got a letter from Barclays with four reference numbers on! Rang them and they have forwarded the four policies to the decisioning team, I think the original loan was for approx £10k in 1998 and he topped it up by a couple of thousand each year for the next few years, we paid it off in 2002 I think, I have no clue how to work out any possible refund that may be calculated, any ideas? I'm trying not to get too hopeful but it's hard!
This will depend on the PPI that was actually paid and the rebates they gave at settlement.
When you get the figures, post them up and someone will take a look for you.

claimed back ppi for girlfriend and they have offered an amount..just need a couple of things cleared up before accepting

when the calculation states less early settlement is that because another loan was taken out whick is seen as paying off in part the original policy premium

in turn is that why the later loans have zero amounts under original premium ppi but all figures are under residual

    for example....original ppi..£1351
less early settlement (date stated is 3 weeks after the next loan taken out) £904
the above loan was originally £6952 60mnths @ 165 and lasted 22/02/05 to 18/01/06.....this was then replaced by loan taken out 13/01/06 of £6200 60 x £147....and so on

hope this makes sense and thanks in advance..
This is right, when each loan was settled they would have given you rebate of the PPI, the remaining PPI after the rebate would have been carried over to the next loan and so on, this is the residual amounts.
Did you only have the one loan with PPI? each loan that had PPI should have shown the PPI for that loan, it is possible that they have paid this in the residual amounts.

    Hi all
Well after 11 weeks and alot of !!! kicking, i spoke to Fscs direct today and my claim has been upheld :j. It was a HP agreement in march 2005 with single premium ppi which was £724 ppi plus over £300 interest.
Was messed around alot by welcome and eventually told they thought a 3rd party sold the ppi! Which was just more timewasting as they haven't mentioned the '3rd party' again.
Just got to wait for the funds to go into bank, don't know how much yet though.
Thanks to all who gave me advice and for all your input, it's appreciated.
