    Hi,

Had anyone had any luck claiming back PPI from a DCA? I mean when a loan was passed to a DCA part way through, thus terminating the agreement with the bank. My bank only want to refund the PPI that I paid until the loan was passed to the DCA!!

    Thanks

You need to get the balance that was passed over to the DCA , you will also need the agreement to show the PPI that was put on, if the balance did not reduce when passed over then you would still be paying the PPI and you need this remaining PPI given back to you, send info to the bank to prove you were still paying this PPI and ask them to redress or you will take this to the FOS.

When I spoke to them today they have put a claim forward for us and we will get a letter in 5 working days.
    Do we have a case?
You certainly do, this is a win, when you settled the loan they would have given you a rebate of the PPI but the remaining PPI was paid back by you in the settlement.
Also as this loan was a joint loan could they take payment (all or some) for a loan I had in my name alone?
We are with a dmc and currently paying back an agreed amount each month. My loan was with barclays.
It is possible any redress will go toward the DMP and distributed accordingly, having said that, FP could send the redress to you as the Barclay loan may not show up on FP system, you will have to wait and see what they do with this, if you expect to get nothing, then you won't be disappointed if you don't, if you do get something then that is a bonus.
Also should we have had a refund after 5 years as when I asked this tiday the woman from firstplus (finance something sorry can't remember) asked did I not get a letter about this last year, which we didn't
As you cleared the loan, the cash back is void as the PPI is cancelled.

    8. In addition to this I received back from my SAR letter a number of accounts which I sent a letter for asking to claim. They have sent me about 8 FOS forms to complete with claim numbers on but have not put which forms associate to which accounts, another stalling tactic I feel.
Call them up and ask what these relate to, you can then complete the forms and post them.
This will save you going over old ground and repeating.

Congrats to all the people who have had success - great news :T

Amersall - any chance of a bit advice please?

My Halifax loan of £7500 which had front loaded PPI of £2445 was settled around 6 months from the end. So, paid my fixed monthly direct debit amount for around 54 months of the 60.

My other claim with M&S I paid the full 60 months via direct debit and did not settle early.

Will settling early affect my claim if I'm successful? Or, will they deduct a percentage of the PPI refund?

Hi, you will get the whole PPI amount back for both loans, when you settled the Halifax one, as it was near to the end of the loan, they will have given you a small rebate of the PPI this they will take off the redress.
Plus you get the 8%

    Hi all

This is my second post. Thought I would let you know how we have got on so far and some advice would be great (Amersall!).

Hubby and I wrote off with our complaints in April and so far we have heard from Santander and M&S Money with successful claims with just over £3000 combined! However, today I have received a letter back from Llloyds who have not upheld my complaint about 2 credit card PPI policies.

In their letter it states that they tried to ring me twice but were unsuccessful. This was an attempt to 'improve their understanding' of my concerns. They rang my home phone and left no messages and as I was at work I had missed the calls. They have therefore completed their review based on their understanding of my initial contact. I have rung them just now but only spoke to a call centre person who didn't have much clue. It says if I can provide further evidence within 28 days they will look at it again. Hopefully, this is a positive sign?!

Basically they are saying that the policy would have been verbally explained to me on the phone and I would have been aware of what I was purchasing! They have not taken into account that I was working for the Civil Service at the time and had more than adequate cover for sickness and redundancy. Shall I ask them for proof of the telephone conversation although it goes back to the 90's so doubt they would have any evidence. It seems a very flakey reason to me.

I am going to write a letter and send it off as they will consider any additional evidence. Has anyone else had a complaint not upheld based on verbal agreements? Their letter says they expect their members to conduct business with utmost faith and integrity. I've banked with Lloyds all my life so am keen to pursue this further!

Just to add (reading the letter again) they have based the decision on my telephony complaint form which is not the FOS questionnaire I sent in a week later. Makes me wonder if they looked at it properly at all?

They are awaiting the redress that you are owed so they know what to pay you, it is possible they could take this iff the debt but you won't know this until they send you the calculations.

Write back to them and ask for a copy of the call or transcript to show what they based the rejection on and ask them to look at the questionnaire that you sent in and not the telephone complaint that you made.
  • I applied to get PPI back for two EGG cards, green and blue. The Green claim was rejected but I got £13.98 for the Blue one which represented the initial payment. I don't have access to my Egg accounts as I closed them some time ago but does anyone know if the PPI (or CRP as they call it) was a one off fee or monthly/ annual charge?
    Many thanks Marion Witton
