Thanks di3004, the worst one is the Capital One card, I'm going to put a claim in to them but doubt it will be successful but I will lose about £300 a month in a couple of months time, (child leaving school) so lose tax credits and family allowance. If I could get rid of the other debts the loan is the least of my problems.0

Interest at 8% £546.40
Excess Balance £73.70
Also how much would then have to be paid to tax man?

A Sar is 40 days, this includes weekends, give them time.
If there are other loans, when you get the Sar, that you have not claimed for, then put the complaints in for these, if any of these loans were used to repay another loan off then they will look at these if you already have the complaint in, just to be on the safeside, ring and ask if they are looking at these if you get anymore info.

Thanks to everyone on this site, particularly dilus and amersall. The 5.6k will be a big boost to my house-deposit fund. My advice to anyone is go for it, it only cost me an hour or so or my time and the cost posting the forms. Any queries I had were answered brilliantly on here. Very happy!0

Quick question, who is David Chan, I've e-mailed Bob Diamond twice with no response and I'm now at week 18 for an Egg card now being dealt with by Barclays due to ring them again this week last reply was it had been escalated to the directors office
Is David Chan someone who will get things moving after so long?

Hi all,
well after reading many posts on here i put in my complaints to 3 banks.
First final response letter today from Yorkshire bank and as expected from them the complaint was rejected :mad: . The reasons being i would have needed the PPI,also I (so they say) ticked the box and their staff acted with with due care, skill and diligance. They also put in a little dig that it was my own fault i had been paying it since 1996 on a credit card..
Having gone through the copy of my agreement I can safely say the whole application on the card was a fix.. Sheet one shows in my writing that my income at the time was 5k+ and that i did not run a car and yes the little magic box shows a tiny tick (which i did not do).
Sheet two shows Income of 5k+ overwritten to say 13k+ (not my writing by the way) and that my vehicle running costs were £700 per anum ( quite expensive as i didn,t have a car on the first sheet) . a
Also my annual surplus was 6.5K..(very strange when my income was 5k+ to start with..
Half hour after reading the total rubbish on the sheet , logged a complaint to FOS. Now this may take a year to deal with but I am very confident on the outcome

Just phoned and now very upset. I have an open loan and they said they'd be paying the money towards that, the problem is I need to pay off other stuff more urgently as my income reduces drastically in a couple of months time. They are putting in a request to pay directly to myself but I don't hold out much hope. Only good thing is they hadn't included my claim for the credit card in their assessments, it had been missed off altogether so that's being started now. Just feel like crying at the minute.
It's so unfair, yes I got myself into trouble by overspending as so many others have but I've never been late with a payment, and I've got my loan scheduled and can easily cope with the regular payment. However if I hadn't been sold the PPI (had all sorts of cover so it was never needed) I would have paid everything back already and I could really do with this money.
If they come back and say they are not giving you this money, write back and explain about your reduction in income, if they still say no then send it to FOS explain that you do not want to be in more hardship in a couple of months and feel you have other priority debts to reduce.0 -

If you have no arrears and you keep the win,you get it all back, the 8% is taxable if you are a taxpayer, I believe it is up to the bank if they give you the 8% if they are taking any win from a loan, as I and Di said previous, go the hardship route and plead your case.0
