    how would they know you got a booklet or are they just assuming (prob something they will hit me with)
    They post it to you or give it to you if you do this in branch, According to FOS, this is not a reason for rejecting the complaint.
    I hadnt claimed as had cover and sick pay and went long term sick in 2003 but didnt claim on ppi as never knew I was paying it
    I hope you told FOS this, this adds weight to your mis sell, you did not claim and paid the card as usual, this proves you did not need PPI.

    Hi, I'm new to forums and this is my first post so I hope I dont show myself up! I'm after abit of advice, a few months ago I received a letter from my NEXT Directory advising me that they would be cancellng my payment protection insurance?????? I knew nothing about paying this and feel abit of an idiot to be honest. I have not used the account for over a year and when I pulled out some old statements it was staring right at me. I was so annoyed with myself that I prnted off a claim form and proceeded indepedantly. have just received my response back from NEXT who are basically sticking their fingers up at me saying they are not in the wrong because they are not a bank and i cant complain to the financal ombudsman because they are not regulated?????
    Any advice would be very much appreciated, thanx.
    Contact the FLA and see what they can do, if it only came to your attention when they contacted you regarding this then it is a mis sell, give FOS a ring too and ask what you should do.

    They usually take the arrears back, as the debt was sold on it is possible you will get the cheque as promised, see what they do.

    It seems that they have treated the 3 loans as individual cases, and not taken into account that the subsequent loans were consolidation loans.
    They have been redressed as a separate loan, they will give you the PPI back for all 3 and take back any rebates they gave you when you settled.
    The one without the paperwork, they have given you a gesture, unless you have paperwork, then this is all you will get.
    Would you accept this offer and let that be the end or do you think I should dispute it because they havn't taken the consoidation status of the loans into consideration. Is there a chance I could end up worse off?
    They have taken the whole loans and the whole PPI into consideration, they have given you the whole PPI amounts back for the 2 loans less any rebate they gave you when settled, the remaining PPI that was passed over at settlement after the rebate is in with the whole PPI amounts that they have given you back.
    I found it strange that the money was in my account before I'd received the letter with their offer - let alone accept it.
    They do this for speed rather than have you wait for the calculations and then have to accept, you will get the figures and they will show the whole PPI redressed, if you think this is wrong you can go back to them and dispute this.

    Calculation letter arrived after I received the cheques!

    1st loan
    refund of premiums 278.01
    refund of interest 70.53
    interest at 8% 311.70

    total 660.24

    2nd loan was a refinance of loan 1

    refund of premiums 883.19
    refund of interest 265.68
    Interest 8% 836.01
    other indirect losses 10.00
    excess balance 120.87

    total 2115.75

    3rd loan was a refinance of loan

    excess balance 67.21
    interest 8% 22.18

    total 89.39

    "as you repaid loans 1 & 2before the end of the agreed term the refund takes into account the insurance rebate which was included in your settlement figure"

    I'm not satisfied with Santander's response, and acknowledge that the agreement shows my signature selecting PPI, but believe they have failed to prove they assessed my needs in order for me to sign the agreement. My company provided me with good benefits, and I had the means to re-pay the card, but Santander have not made any comment or proved what measures they took to prove that although I had other means, I would still have benefited and it was within my best interest to have this insurance.

    Write back to Santander and reiterate what you said above.
    Contact FLA and tell them this too.

    Then put a complaint into Santander and ask for the PPI to be cancelled or you will contact the FOS regarding this, you have asked this back to cancel the PPI and they have ignored you and you have paid PPI that was mis sold for longer.

    It is possible it has gone to what was owed after bankruptcy, the bank can have money back that is owed I believe.
