    Hi,
    I need a bit of help please if possible .
    Myself and my hubbie are in the process of claiming back ppi from various accounts.
    Hubbie has had ppi on a LLoyds tsb credit card since June 2001. He filled in the complaint form stating that the ppi wasnt explained to him fully and also that he was unaware of the cover and it was added without his knowledge.
    They have rejected his complaint today stating that he would have been provided with documentation at the point of sale and after purchasing the ppi which would have explained everything about the ppi. He has no recollection of receiving any documentation.
    They also say that they 'required additional consent in the form of a ticked box to confirm you wanted ppi...I am persuaded that this required a verbal explanation ensuring that you were made aware of what you were purchasing. It can therefore be concluded that you did knowlingly consent to the addition of a ppi policy to your credit card'.
    We are bemused. They have no pysical evidence of a ticked box- as they never had consent. The card was obtained over the telephone.
    Can someone please help us with what to do next as the letter advises that we have 28 days in which to contact them with additional evidence after that its the FOS.

    Hi there

    Write back and give them any further information in regards of this complaint, tell them you do not agree with the decision they made on rejecting your complaint, as they have not provided any concrete evidence, and you don't believe they have considered your reasons fairly to this complaint.

    Do you know if the tick on the agreement was pre ticked (bank ink)?
    Lloyds TSB back then, from what I can recall, it used to be added before the paperwork was signed, and it's then confused on assuming PPI was all part of the credit card package, because with not being told any different.
    If this does apply to you, then mention this on the letter as well.

    Tell them your not happy with the way they dealt with your complaint and feel they have overlooked a genuine case and you want them to reconsider with the extra info you have provided.
    Also state that, if they have any concrete evidence of this being agreed, you will be happy to receive this, so please enclose the details.

    Also mention that the documentation if that was provided, it was still assumed the ppi was all part of the package, despite receiving this, but this does not excuse the fact that it was mis sold.

    Anything that applies to you, (hubby) that you think you may have also missed, please add to the further information, for example, was your hubby already protected by his employer for sickness, at the time of taking out the policy?
    Was there a pre medical condition at the time of taking out the policy?
    Unemployed?

    If they did not explain the policy was optional, then do add that as well.

    Hope this helps for now, and I do hope they come back with a better response for you on this.

    I would also like to point out as well, as its a credit card ppi, they may come out with something like:
    It would cover for job solutions, if unemployed.
    Hospitalisation.
    Life Cover.

    But the point here is, that even so, with the reasons you have, the policy may still have been worthless to you (hubby) if he was then protected by his employer then for example.

  • I've attempted to reclaim PPI back for a loan I had with welcome finance. I've gone through all the letter writing and form filling, sent copies of my agreement etc. Welcome Finance have written back and told me I have to claim the money back from Safestyle UK as they're the ones who sold me the finance in the first place??? How can Safestyle be liable when it's Welcome Finance who have received the money I paid?
    Hoping someone can advise
  • Sent a letter from MSE on 27 Feb 2012 to Black Horse. Received questionnaire 13 March 2012. Letter received today upholding complaint and paying back £1806 - a very happy bunny :j:j
  • Received letter from Northern Rock outlining repayment of £2,900 for the misselling of PPI on my mortgage of 10 years this included 8% interest.:j
    I used the template questionaire on your web sight. My wife kept on to me to apply as we had nothing to lose and boy o boy was she right.
    It was so easy to do and Northern Rock's reply was really quick.

  • Thank you so much to MSE team. Wrote off to Sainsburys about a loan my wife I took out with them circa 2005 and which was repaid which we were clearly misold PPI.

    Acknowledgement letter on 23rd March...letter today with offer of £4974. Ecstatic!

    Just realised we took out an earlier loan with the same lender, same modus operandi re PPI but paid off in 2002. I have lodged a complaint over the phone....is this too early and is this a chance that this will get batted back?

    I've just had an offer from Barclaycard, and would just like some advice.

    I had the card for 20 years, but didn't use it much. I don't have the old statements to check if the amount they have offered me is correct, but it seems about right.
    The offer comprises of refund of the payments I made for the PPI cover, refund of interest charged on PPI premiums, and 8% interest per annum.

    Should I accept, does this sound fair?

    Success with one of my PPI claims with MBNA for a Virgin Credit Card, all it cost me was about an hour of my time & 2 stamps & I am getting back £4894 inc interest. Follow MSE guide on this website and use the letters and complete the questionnaire, thank you so much MSE, I love you Martin!! :T:j:money::beer:
