hi
HSBC received my complaint on 19th March but having just called them for an update they said it was put on the system on 3rd April so that's when the 8 week time scale starts. Is this right ??
They may reply earlier in any case.0 -

Hello,
I recentally won a claim against Egg banking for £6350.00
Today I get an invoice from the company that was dealing with the claim for me for £2289.00!
This was made up of 30% fee - £1908 but also 20% VAT @ £381!
Leaving me with £4061.00
So in one breath this is a success!
Now my gripe is that I ended up doing the majority of the work as Egg contacted me directly with all the forms which I filled out and sent back to Egg. When I phoned Charterhouse to ask them what to do with these forms they told me I also needed to scan, print and send duplicates to them!
Later I got more of the SAME forms above from charterhouse asking me to fill them out and send back to them and NOT Egg.
I phoned them up and told them I had already been sent the forms direct from Egg and had already sent them back including duplicates to them which they has asked me to do on a prevoius phone call. I also had several "nasty" letters from them asking me for these forms of which I had to phone them two or three times stating that I had already sent them back and had discussed this with them several times in the past.
End of the day I do have £4000ish back, but I feel that I done ALL the work, seeing as I had to fill out all the forms and send all the forms back to Egg AND Charterhouse!!
Can someone please advise me what I should do? Are they entitled to this £2000+ or should I dispute it and only pay them a % of the fee?
Regards

You are the only person who could realisically fill out the forms as you had the relevent info, and only you would know how it was sold to you
What did you expect them to do for the fee?0 -

Egg sent me the forms direct, I filled them out and sent them back to Egg.
It seems that Charterhouse have done nothing and want to charge me £2000 for it.
Im not disputing paying, but I think they have made a mistake somewhere and ive ended up doing all the work!0 -
I took out a credit card with Lombard Direct in November 1999 I am self-employed. I wrote to them requesting cancellation of the policy in March 2006. This was for PPI, although I had never received a policy document. As PPI was a hot topic at this time I requested copies of my card statements and in February 2007 I requested repayment of the PPI from 20/12/2000 to 22/03/2006.requesting to be re-imbursed £978.51 plus 8% interest. I received a prompt response within two weeks stating that theur charges were fair and reasonable etc., and declining to repay me. I contested this comment, they wrote again within a week back in March 2007 informing me that they would leave the file open until April 2007, I told them that I wasn't pleased with their reply.I had sent a Complaint to the FOS in April 2007, for whatever reason this was never recorded. I wrote to Lombard in June 2009 asking what was the current position, they replied in July 2009 giving me six months to contact the FOS, I did reply in November 2009 that I would be dealing with the FOS, but giving them a further 14 days to settle. I heard nothing from Lombard (RBS), due to work it went on the back burner. The FOS eventually got back to me in November 2010 acknowledging my replacement complaint form apologising for the delay due to a high caseload. The FOS wrote to me informing me that I had a complaint against RBS and to send a Consumer Questionnaire to their ppi Bristol office, this was December 2010. No reply was ever received, so back to the FOS, the legal challenge took up a few months of 2011, I wrote again to Bristol PPi office in August 2011, still no reply. The FOS had requested information from RBS since August 2011 but even they failed to get the required information. The FOS advised me to deal directly with RBS and if necessary to claim through County Court action, I wrote to Manchester PPI office in February 2012, but, they reckoned I didn't exist as a person in their records !!! I contacted them today as I hadn't heard from them, according to their notes my claim is rejected because it is time barred.
Sorry for this long drawn out message, but, does anyone have an opinion on their decision that my complaint is time barred ?
Hi Jackswan
I am currently going through a similar 'time-barring scenario with a bank (i'd like to keep this confidential at this stage because of negotiations) who rejected my claim using time-barring as their final response. I sent them the following back (section from my letter):
Time barring and pre-2005 sales
Some firms argued that complaints about pre-2005 sales should not be included in the scope of our Handbook provisions because they are all or mostly already out of time to be considered on their merits (i.e. they are ‘time barred’ under our existing DISP rules). 33. We disagree with this view. Decisions concerning the time barring of individual complaints are ultimately for the fos to make, but in general terms, our view (as set out in CP10/6 para 3.14), is that general media coverage of the PPI issue, including comments or publications by us, would not be enough to have given a consumer the kind of specific ‘constructive knowledge’ required by DISP’s time limits. 34. Accordingly, while some consumers who bought PPI before January 2005 may, on an assessment of their individual circumstances and events, be deemed to have had appropriate awareness before January 2008, such that they will be out of time by January 2011, our view is that this is unlikely to apply to consumers.
Conclusion on pre-2005 sales
There is nothing in firms’ responses which leads us to consider it necessary to retract from our statement in the open letter concerning pre-2005 sales or to carve out complaints about these sales from the scope of our final provisions. To do either would leave substantially unaddressed the poor handling of a very significant proportion of PPI complaints, and thus the significant potential consumer detriment caused by many of these sales.
The above is set out by the Financial Services Authority in their publication, The assessment and redress of Payment Protection Insurance complaints.
Furthermore, I have had several complaints upheld that pre-dated the 1996 time-barring you mention.
Therefore, I would respectfully ask that you reconsider your decision and unless I have a response from you within the next 7 working days I will escalate the matter to the Financial Ombudsman highlighting that my case, a). is not exceptional b). is valid with precedent set by other complaints being upheld in my favour for mis-selling of PPI pre-dating 1996. (Ends).
I have had a reply offering my premiums back but no 8% or compound interest - hence the work in progress.
Also, Barclays are using time-barring in a on-going complaint I have which is now with FOS.
So (in my opinion) its worth sending them the FSA content which might get a reviewed decision. As you have already been to FOS I guess that just leaves CC but the FSA info might prove useful in your argument.
Hope this helps. Good luck with your claim.0 -
Put complaint (consumer questionairres) in to Nationwide in February for Loan taken out in 2001 topped up 3 times - recieved letters x 2 mid April not upholding my complaints.
I contacted member service Manager dealing with complaints and he requested further information and employee details as discussed.
Sent them off and confirmed yesterday he had recieved them which he had so I asked if he would be sending out correspondence with a decision on this in the coming days
To my amazement he said he never read the letter x 3 pages answering all his points raised - just looked at my employment details?????? and doesn't have a answer as to where we go from here!!
When I rang regarding the decisons not upholding my complaints he was very efficient in his approach and now all of a sudden he is coming across as lost and doesnt have answers!!
I have now contacted the FOS and all correspondence is being sent to them!!0 -
Hi all,
I've just phoned up Lloyds tsb PPI claim line to complain on 4 loans dating back to 2003, which was relatively painless. I informed them i believe i had been mis-sold PPi by them by means of pressurising me into taking it out! Whilst i can't recall all details and vividly remember them saying you should really take it even though i had sickness and redundancy package at my employers.
I was just wondering have people had much success with their claims to Lloyds tsb? Any help/advice is much appreciated.
Fingers crossed, see what happens!0 -

Hello there
If you made the complaint by telephone, maybe it would also be wise to also put it into writing as well, just to make sure they confirm they registered them on the date of XX/XX/2012, if they given you a complaints reference number make sure you write this as well.
You could also email them to ask them to confirm, if they have not yet given you a ref number, request for this too but emailing.....

I am not saying they will not deal with your complaint, but it's been known that verbal complaints are not always authorised.
I have been successful with all mine.
Keep at them, good luck.:)The one and only "Dizzy Di"0 -
