I'm just claiming against egg for an old loan, could I just ask what your reasons for it being missold were? And also I sent just a letter about 2 weeks ago and yesterday I received the questionnaire, did this happen with you?

I listed a few reasons, firstly that i believed that the PPI was either not made optional or was pre-populated on the website as I did not select it. Secondly, when the loan agreement was sent out, I was never given a breakdown of repayments with and without the PPI so that I could compare, so it was never made clear to me again that this was optional. Lastly I just explained that I have never taken out PPI in any other form (I've had credit cards with them etc), as I've never needed the cover so I wouldn't want it then.
I never received a questionnaire, I sent off a covering letter, along with the questionnaire provided here as my original documentation. They acknowledged the letter within about a week stating that they were looking into it, then received the letter yesterday upholding my claim.

I received a rejection letter today from M&S with a copy of my original agreement from 1993 where the PPI the box ticked. They also said that I requested the original application form & posted it back. I am sure the form was filled out in store as they plugged their cards so much back then but do I carry on? I have never taken PPI on any loan or mortgage as always had full cover through employer.0

First of all, I'd like to say thanks to everyone who has posted in this part of the forum.
I always refused to take out PPI on credit cards and loans as at the time I was a civil servant and had good sick pay and the threat of redundancy was low. However I realised some time after taking out one MBNA card about 10 years ago that it had PPI automatically added on, which was not something I would ever have agreed to. I had actually forgotten all about it till my sister told me to look into making a claim recently - and this is where everyone here came in.
I made the claim in the middle of last month. I didn't hear anything back until last week, when I received a letter saying their enquiries were continuing and I would hear something by 4 May.
However, today I have received a letter containing a cheque for £488.88, saying it is enclosed as promised further to recent correspendence and it is in full and final settlement of my complaint.
I haven't received any such correspondence. Is this usual for MBNA? I would like to check that the offer is fair - it was a card that had quite a low credit limit and wasn't used regularly so I think it probably is, however I'd like to check and I also need to know how much of it is interest for the taxman...something I only know about thanks to you guys :T
I called them tonight and was told I should hear something back within 10 days. Do you think I should cash the cheque or wait for their response?
Of course I wouldn't be surprised if the "recent" correspondence shows up sometime next week :rotfl:0 -
Wait for the letter from them and see if they are paying the 8%, when you get CC redress they reset the card to zero balance and calculate redress from there, any month the card had a credit balance they will not pay the 8% for that month.
Do not cash the cheque until you are satisfied they have redressed right, hopefully the letter will show how they calculated this.

Thanks amersall - I paid off the card about a year ago and it actually now has a very low credit balance, but it never did while I was paying the PPI premiums.
Great advice, I'll wait to cash the cheque until I hear back from them. I know it's not the megabucks some people are getting back, but I'm happy.
I'll probably be back once I get the breakdown from MBNA for your expert views :T0 -

I made a successful claim against RBS for insurance on a credit card. I phoned them after receiving a letter saying that as I was approaching my 65th birthday they would be cancelling the credit card insurance. I rang to say that I wasn't aware that I had insurance and had never asked for it. I said that I had filled in an application form received through the post in 1986. Within a few days I received a letter making me an of offer of £950! I didn't even have to fill in one form!0

just wanted to share with everybody that my cq's have arrived from First Plus :j
all in all it has taken 4 weeks and 3 days from me sending in my original complaint so for once Well Done First Plus !
My advice to anyone reading the posts and thinking of claiming is Please Please Please follow the advice on here and Do It Yourself its worth itEveryone needs a little help sometimes :T
