    Hi Michelle

    Sorry for the delay.

    Right ok not a problem.:D;)

    The FOS will look at both sides, consider what evidence you also forward to them, so if you forward your details and copies of paperwork, they will of course take it all into account.

    The main of the FOS complaints are overturned more so than rejected, especially when it comes to PPI.;)

    Hello All,

    I had 4 loans with Barclays starting in 2000 and ending in 2007 all with PPI which I never knew anything about. Basically I consolidated all these loans to 1 in 2002 and that was paid up in 2007. So I sent my complaint off on 14/02/2012 and got my 4 letters back yesterday. They have rejected my 1st 3 loans but agreed I was mis-sold on the final loan and paid me direct to my bank on 10/04/2012. I have contacted the Ombudsman who are on the case as I cant see how they can do this! I will let know how it goes.

    Wanted to say thanks for all the info and posts on this site.

    Had a result today. Took out TMPP in 2001, paid £49 a month for 84 months before we paid off the mortgage.

    Sent a form (from the Halifax site, not this one but they are pretty similar) 20th Feb 2012. Basis of complaint:-

    1) I get 6 months full pay, 6 months half pay for sick leave.

    2) We were told that we would not be given the mortgage if we didn't take out their TMPP product.

    Got a holding letter on 23rd Feb 2012. I spoke to them on the phone today, they have agreed to pay out £3139 in compensation. This is less than we paid in in total, but someone posted a few days ago here, stating that Halifax will refund the PPI element (sick leave, redundancy) but not the life cover element. Given the amount offered, I'm assuming when the letter arrives, this will be the same principle.

    £3,000 is a cracking result, especially as lots of people on this forum have stated that Mortgage PPI is rarely misold (although I couldn't find a single post about an actual refusal).

    £3,000 equals cleared credit card, modest family holiday and a PS3! In your face, Halifax!

    An update. Got my cheque in the post today!

    Also, the letter I got a few days ago says that they had not investigated the life cover element (rather than they had refused to pay it) as they don't consider it PPI, but that I could request that they did look into the areas of the TMPP. By my calculations this would be another £4,000. I have asked them to look into this for me so will keep you posted if they pay out.

    It just says on the letters the below after the standard looking at the following factors bit:


    In order to reach a decision ,the information I have used will have included the following where available,but not limited to:-
    All the information you have provided me with
    Your recollection of the sale
    Copies or transcripts of phone calls(where they exist)
    Relevant internal procedure manuals that were in use at the time of your sale
    Training material that sales staff would have completed
    Our internal complaint records associated with the person who sold your policy

    After taking all the above information into account, I am unable to find any evidence that the PPI Policy was mis-sold. Therefore I regret that I am unable to uphold your complaint.

    The thing is I put the same reason on all 4 forms to why I thought I was mis-sold. The only thing I changed was they policy numbers and dates

    They've obviously been dealt with entirely separately. Did you complain about each individually? Didn't you make it clear to the Bank that these loans formed a consolidation chain?
    What were your complaint reasons?

    I told them at the time they I raised the complaint about the loans being consolidated. On the forms I just filled in that I was never told about anything like PPI for each loan. When I spoke to the Ombudsman man he said he will send new consumer forms and told me to mentions that all the 3 rejected loans lead to the main loan that I won the case on. I feel a bit stupid for not putting that on the original now but i would of thought they knew as I told them and the dates all tie up

    Unfortunately for you, the loans have each been treated as a separate complaint. That's why you received four different replies.

    Be warned that you can expect many months waiting for the FOS to sort it out for you (if indeed they can).

    To be honest I dont mind waiting because now I feel they have not got a leg to stand on as they have paid out on the last loan I took out to consolidate, do you not think?. Just shows how they just reject without looking into things and how different people uphold your claims
  • Many thanks for all of the guides, notes and templates on the site. I must admit I approached the whole PPI reclaim process with some trepidation. It couldn't have been easier.

    So far, successes are:
    Egg (Mortgage) - cheque received for £9,001
    Egg (Loan) - cheque received for £2,743

    Outstanding (letters/claims despatched earlier this week) are:
    Egg (Credit Card) - now with Barclaycard so could get tricky
    Lloyds TSB (Credit Card) - extremely confident on this one.
    American Express (Credit Card) - letter went off today as I had forgotten about this closed account
