I've had a halifax personal accident plan taken out via first assist since 2007 and have being paying around £12.00/month. I don't have the original documetations when offered the plan so how do i know if im entitled to any payment from being missold. I don't want to involve any firms which offer their help due to the refund payment if successful. Would much appreciate any advice. thanks

Strictly speaking this is true. However, if the sale was on or after 14 January 2005 there is no point in taking this route because if the intermediary (or the firm they represented) still exists, you can go to FOS or, if it does not, to the Financial Services Compensation Scheme.

Prior to that in theory it will work - but only if you can prove a missale, and probably that you can prove it to the satisfaction of a court, not just FOS.

Firstplus have still insisted i go to the broker,my reasons for mis sale are that the sales advisors pressured me into taking out PPi as the loan would unlikely go through without it, also i complained about the 5 year cashback on the PPi and said it was not fully explained to me especially the bit where you pay for the full term of the loan, which was 15 years.

Firstplus have said that the 5 year plan was fully explained in the Tand C's and i signed to agree on this, with regard to the sales advisor they said they hold no phone records prior to 2005, also i have to contact the broker with this complaint, so cant see how im going to win this one.

had a reply from hsbc this morning regarding ny cc, it is been upheld, giving me £288 back not a lot but didnt really have high balance over years so happy with this better off in my pocket. I am still waiting for my rejection letter off lloyds that they said they posted on 28 march hasent arrived today, will wait to see what they say then reply to them. thanks for all advice given on this site you are all fab x

I'm still waiting on my rejection letter from Lloyds and it was dated 22nd march. Lloyds are not great to deal with, I think they are rejecting more claims than they are upholding.

I totally agree with you regarding lloyds but I won't give up as I don't ever remember agreeing to the ppi, they must think we will just roll over, is yours for cc or loan?

    Hi and welcome

I am not 100% but think Santander, what you could do is give them a quick call (Santander) and ask them are they the ones dealing with ppi complaints.

Meanwhile, hopefully someone will be along soon to confirm.

    Good luck.

  • My late husband & I took a loan for house refurb in 2005. He was some years older than me and retired. Natwest insisted that we took PPI as the main income was mine, although I had 6 months full pay in the event of sickness. I paid the loan off in 2007 when I sold the house after his death. At first I thought that I was too late to claim, but realised that I was still PAYING the loan within the 6 years. Of course I had shredded all the paperwork. However I wrote to NATWEST and checked my credit report for details. After about 8 wks I received a reply, my letter back (?) and a form. As well as the form they asked for my husband's Death Certificate and the probate or letters of administration. I found it VERY traumatic to go back through everything, there was no probate - we never had enough of anything for it to be necessary. I have no recollection of whether it was front-loaded, how much of the money was loan and how much PPI, the starting balance was £32,244. I sent the form, the death cert, a copy of my original letter and a covering letter of on 26/03/12. As they took 8 weeks to reply to the first, I imagine they will do so again, but does anyone have any advice/comments?

    Hi there

I am not sure if this is the same as PPI, but like any other product if your not happy for some reason, you are in your right to reclaim on the premums made, if you think it was mis sold then give your reasons on the reclaim questionnaire form below, good luck with your reclaiming.
